23/02/2023DefenceIt's hard to remember what i did last week never mind over 2years ago but after checking through my emails i did actuallyreply to this original fine and offered to compensate the companydirectly for £20 and the reasons i wrote on that email for parkingthere was there was roadworks on the road so all parking wassuspended and I was collecting emergency supplies for someoneduring covid so i pulled onto this bit of land that had no parkingbays and it basically just looked like a disused bit of space iwas unaware of the contract parking terms and conditions or evenwhat the fee was or fine but i thought the offer of £20 for a 32minute stay was fair and reasonable but the cowboy parking companythought £100 for the brief time spent there was appropriate. I wasvery surprised to find that instead of accepting my reasonableoffer that i made they thought they could bully me into payingan extortionate amount , how they can now try and justify £182 fora 32 minute stay is beyond me and hopefully you will agree with mejudge as these cowboys need to stop being able to get away withthis. The defence that I would like to submit to you is that thesecharges are disproportionate and unfair as far as I am aware underEnglish law, penalty clauses designed to disproportionately punisha breach of contract are not enforceable, especially as I was noteven aware of the contract nor did I agree to it. Hopefully youwill agree that paying £100 to settle this matter is a fairsolution.
