After I returned to my car to find the parking ticket on the window, I went over to the machine and enter my registration number again out of curiosity to see what message I got. The message was the same as I recall seeing the first time. I do realise with hindsight that going to the machine and doing this has now given them the impression that I have tried to be crafty and initiate a session at 5:31. However, that was not the case. Clearly the 5:31 session did register correctly. They make you enter your reg number because there is a maximum 3 hour stay. Can you recommend wording for my formal appeal or should I just submit anything on the basis that Havering will doubtless reject it regardless?

Hello, this is the OP Derya but I'm posting from a different account. Further to the last message, the address on the logbook is correct.

Unhelpfully the notice to owner got delivered to a neighbour and I've only just received it today, meaning I have less than 48 hours to pay or contest the charge. If I contest, it will increase to £165 from £110 if the appeal is declined.

I have read other reports of similar issues with this parking area on Facebook, leading me to think that there may be a fault with the system, however, that is just conjecture and I have no way to prove it. I also understand that Havering refuses all appeals at this location.

I really think the authority should issue a ticket once the reg number is entered to remove any doubt.

Assuming my formal appeal will be rejected, do you really think I have any chance at tribunal, or should I cut my losses and pay? If you feel I have a strong chance at tribunal please can you kindly propose wording for the formal appeal.

Thank you, what threw me was that they make reference to a 'notice to owner' but haven't sent me anything with that title.

Anyway, I've gone on and submitted my formal representations now on the basis of the above.

I've gone on to make the appeal and have received the following message:

"Informal Challenge Denied
It would appear you have already been sent a Notice to Owner.  At this time you can only make a Formal Representation.

Please click here to make a Formal Representation.  You will need your web code which was supplied on the Notice to Owner."


My PCN isn't headed as a 'notice to owner' and I haven't received any other correspondence. Should I go ahead and make the formal representation, or has there been a procedural mishap on the part of the authority?

Thank you all for your helpful replies. Please see below my proposed appeal for your review:

I hereby appeal this penalty charge on the grounds that the contravention did not occur.

Following my being temporarily stopped in one of the drop off & pick up bays on the opposite side of Station Road outside Gidea Park Station, I performed a traffic manoeuvre to turn the car around in the road in order to face in the opposite direction.

During performing the manoeuvre, I had to reverse slightly due to the parked car in front of me blocking my passage. This was a momentary and nominal stop, too minor to be of consequence, and purely to complete the manoeuvre.

A restricted bus stop is intended to stop people from stopping to board or alight passengers, and the video evidence clearly shows that was not the case for my vehicle. 

Please can you kindly cancel the charge.

This incident occurred when I performed a u-turn having been parked for a short period in a legitimate drop-off point outside the station. I do this regularly, u-turns are permitted, as is passage through the bus stop when performing the u-turn.

However, on this occasion, somebody pulled up and parked in the bus stop, meaning my passage through was obstructed. I therefore needed to reverse up slightly to complete the manouvre. I'm providing this context so that, upon your review, my car isn't mistaken for the one already parked in the bus stop at the start, nor the black one that pulls in at the end.

Essentially I had no intent to stop in the bus stop and whilst my car stopped rolling for a second or two whilst transitioning from forward to reverse gears, I believe this is an unfair ticket and not in the spirit of the law which is to stop people using the bus stop as a parking or drop-off point. It was clear this was not my intent.

I feel compelled to appeal, but Havering doesn't offer an extended discount period if it rejects the appeal, so only want to appeal if I've got a good chance at tribunal. I sense that I have but would welcome the input of your experience and knowledge.
