I contacted Pay-by-Phone over 2 weeks ago. They auto-acknowledged my request but have not replied since. I had to submit my appeal to Lambeth, therefore, without this input. Only they can hope to explain what happened with my payment attempt

Pay-by-phone seems to be a huge international company. The best I could do was to send them an email. Trying to sort it with them seems nigh on impossible. And I can hardly defend myself without their help
Might it matter that the PCN does not mention the specific bay, each which have a unique identifier, it seems
Also, P-by-p seems to be app-based. I was not aware of this and did not have it nor was it recommended that I install it to book the parking. In addition, there was no message that the payment had failed. Yes, I'm grasping here

Thank you. I will do what I can
However, I never got to an visual phone app. It was all voice commands, and field entries on my phone which why it was difficult (fat fingers didn't help). The only thing I have is my call history. I'm am not sure how to copy that so it can be posted

I parked in a pay-by-phone bay. It is not something that I can recall ever doing. I (or my young son) had, seemingly, downloaded the app at some point in the past, I was surprised to discover. When I tried to login, I could not remember the password as I had never used it or, at least, I don't recall ever downloading the app and setting up an account
The computer did not help by not stating the parameters of the password and it took some time to request one
I have found 3 calls to the pay number between 12:47-12.51 in an attempt to enter the account and book 2 hours parking. I thought I had achieved that and was shocked to find the PCN when I returned to my car around 14.40h.
I cannot find any confirm from the app but, not being familiar with it, had no reason to expect one. In addition, I was in the cinema and my phone was switched off
It seems that my payment did not go through. It could have been that there was an expired card associated with the app. I don't know how that works. I entered my current card but it does not seem to have been recognised
I do not know what to do at this point but it seems harsh. The 3 calls show that I was trying

Thank you both for your replies. I did not mean to give the impression that I was taking this matter as life-threatening. I was just curious about the value in contacting the council in advance to demonstrate that it was an error, not an intention. I obviously would prefer not to have to cough up any penalty

My message has somehow been moved into Flame Pit. I do not know why. I needed some help in locating it. The links received in your email alerts led to an error message

I will, indeed, post the PCN when it arrives

Last evening I was driving in an area of SE London with which I am not familiar. I was travelling northbound on Rye Lane. I was heading to a nearby Morrisons
At the junction in the attached map, my Google Maps, I believe, told me to continue on Rye Ln, and I bore left
I did not see the signs that indicate that cars are not allowed. I believe that there was a bus that block the sign on the right, and the End of Route sign partially obscured the sign on the left. At any rate, with the poor twilight, I missed them. I found it odd that there was no traffic on Rye Ln. I carried on until Hanover Park where I did see signs, and turned right
I later drove by the initial intersection and noticed the signs. It seems that I should have borne right on Rye Ln (it goes both straight and, briefly,  right)  which then becomed Copeland Rd
I wasn’t trying to sneak down Rye Ln and, other than the Google Maps, I cannot explain how I made such an error. I appreciate that one cannot blame GPS systems for bad information
I await the PCN
I wonder if there is any benefit to contacting Southwark Council (I believe) and pre-emptively confessing my guilt and confusion?
I do not hold out much hope

It doesn't seem very prudent to count on the Council, even though it is Lambeth, making a major clerical error in order to win this. Of course, they might never send me either Order

I thought when I read guest17's contribution at the top (May 11), arguing that the sign was defective, even citing a case to that effect (sign not stating that it is only in force during school terms), that it was spot on, but you have not mentioned it

I also suppose the fact that the school had been out 35 minutes before I drove by and that the road was completely clear of any pedestrians, doesn't matter a hoot

So, it is double-or-nothing

My alleged contravention was 29 April

At the top of the new order, The Lambeth (Moving Traffic Restrictions) Order 2024, it states:
Coming into force:- 27th April 2024

However, in the first point it states:
Citation and commencement
1. This Order may be cited as the Lambeth (Moving Traffic Restrictions) Order 2024 and shall come into force on 29th April 2024.


To my untrained eyes, the Order is very different to The Lambeth (Prescribed Routes) (No. 11) Traffic Order 2022, which it has, if I understand correctly, replaced

The original order cites Part IV of Schedule 9 to the Road Traffic Regulation Act 1984(a); the recent TMO cites the Local Government Act 1972, or section 19 of the Local Government Act 2000

There is no mention of school streets nor of the type or requirements of signage, which is the point brought up on this forum by guest17

The only passage that refers to pedestrian zone is “pedestrian and cycle zone” has the same meaning as in the 2016 Regulations

It also states:
(1) during the hours of operation of that no vehicles prohibition.
(2) during the hours of operation of that play street no vehicles prohibition.


I do not know if any of the above is helpful. The signage argument offered by guest17, specifically mentioning that the restriction only applied during term times only seems well backed-up by the case involving Camden

I will await your replies. I have heard nothing from Lambeth in regards to my request for the Order. I appreciate that I now have access to it (them), but if  Lambeth just ignores the request, could that not disqualify the prosecution?

Is there anyway to accelerate the process of getting the TO that I have requested from the Council? Can I go in person, for example?
I am conscious of the discount period ending 11 June

I have just received the attached rejection of my representations
Lambeth has re-offered the discount for 14 days dated from 28/5
The letter mentions, in bold, that 'It is only enforced during the school term times' though they do not address the fact that this information does not appear on the applicable signs
The letter later claims that 'our signs are compliant and stipulate the restriction information'
I made a Request for Traffic Order 2022 under sections 6 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984. School Streets on 12/ and 24/5. I have not had a response

That only leaves me 3-4 days, doubltfully enough time to get the Order back from Lambeth
I must be mistaken about the discount period starting on the date of service as opposed to date of issue
What is the argument for the representations?
