Happy new year to fellow FTLA members!!

I've just had a response from Gladstone solicitors further to the email I sent them earlier. They've sent an evidence pack which is pretty much just the 2 NtK and a bunch of pictures PPS have. No site map or contract agreements between PPS and landlord have been sent. I've attached their email response and the evidence pack they've sent me which they claim is sufficient for them to initiate legal proceedings on failure to pay the amount due.

Greetings and thank you to all the advisors who contribute to this forum.

I have just had a Letter Before Claim sent from PPS's solicitors Gladstones Solicitors.

I have attached the letter. It says in the letter I should respond to them if I want to dispute the charge. Should I do this and explain the circumstances? If yes, is there a format I should stick to? Any advice is greatly appreciated!

Timeline of events so far

28 Jan 2025 - Date of alleged breach and driver liability
04 Feb 2025 - Parking Charge Notice received
08 Feb 2025 - Response(appeal) from keeper
22 Mar 2025 - Notice to Keeper received
23 Mar 2025 - Complaint raised with BPA (PPS website was not accessible)
28 Apr 2025 - Emailed BPA asking for an update on complaint
06 May 2025 - Emailed BPA asking for an update on complaint
12 May 2025 - BPA response received (to ask PPS for a copy of their appeal response)
18 May 2025 - Complaint raised with PPS requesting copy of appeal response
19 May 2025 - Received email from PPS along with appeal response and original email they claim to have sent on 14 Feb 2025
19 May 2025 - Responded to PPS requesting them email headers of email they claim to have sent on 14 Feb 2025
23 May 2025 - Received email from PPS along with email headers of email they claim to have sent on 14 Feb 2025

Yep, as you say, it does seem like they sent an email on the 14 Feb.

It still feels like there was some technical issue somewhere as I did not receive that email, just don't know how to prove it. I have searched my inbox, spam and trash folders and it's not there. Moreover, all their recent responses have been coming through just fine, in fact, on the original appeal email thread. I even got their autoresponse email this time which I didn't the first time.

I suppose there is nothing further I can do to get my email provider(Gmail) to confirm if that message was delivered to my inbox or not?

I thought the email metadata is what's inside the marked red circle in the attached image? Or am I wrong in thinking that?

I did redact the message id of the sender and receiver assuming it was sensitive information but can send it over unredacted if needed.

To be entirely honest most of that went above my head as my knowledge about these things are close to nil so I just follow advice on what to do from this forum :)

Am I right in assuming what you've said is more for other experts on the forum to use while responding or is there something I should do.

Hello,

I've just received a response from PPS to the complaint I raised. In their email, they claim to have sent me a response to my initial appeal back in Feb 2025 but I can swear I did not receive that email. This time they have replied on that original thread and it has come through fine. I'm not sure how I can obtain evidence of not receiving their initial email.

Should I ask PPS to provide a screenshot of the original email in "Sent" state instead of just forwarding the original response which technically doesn't prove they actually sent it and can be doctored very very easily (not claiming they did though)?

I have attached the email and the original appeal response which they have sent across.

Ah yes, got it. I wanted to run the complaint format by this forum before sending it to PPS. I hadn't actually sent it yet.

To clarify, you mean explain to BPA that the operator failed to respond to my initial appeal? If yes, I did already tell BPA that the operator didn't respond and BPA have asked me to get in touch with PPS to get the response to the appeal, hence my previous question about the complaint to PPS. I haven't contacted the operator since I raised a complaint with the BPA

I have finally received a response from BPA. It basically asks me to get in touch with PPS to obtain a copy of the appeal response and go through their complaints process. I presume this is the next step? If yes, does the following email to PPS look ok?

Subject: Formal Complaint and Request for Copy of Appeal Response – PCN [PCN Number]

Dear Sir/Madam,

I am writing to formally request a copy of the response to the appeal I submitted regarding Parking Charge Notice [PCN Number], originally issued on 28 January 2025.

I submitted my appeal by email to appeals@privateparkingsolutions.co.uk on 8 February 2025, using the form and instructions provided on your website at the time. To date, I have received no acknowledgment or response to this appeal.

I have since contacted the British Parking Association (BPA), who have advised me to reach out to your company directly to obtain a copy of your appeal response. Given that I received a Notice to Keeper dated 22 March 2025, increasing the charge to £100, without any resolution of my original appeal, this situation is both unreasonable and non-compliant with the standards expected of a BPA-approved operator.

In addition, at the time I received the second notice, your website was not functioning, making it impossible for me to follow up or contact you electronically. Although the site has since returned to service, this disruption further hindered my ability to engage with your appeals process in a timely and fair manner.

I also note that the evidence provided in the PCN clearly shows the vehicle was not parked but merely stopped for a very brief period (approximately 3 minutes) with the engine running, on a public road adjacent to private land. This casts serious doubt on the validity of the charge itself.

I therefore request the following:

1. A full copy of your response to my appeal, if one was ever issued.

2. If no response was sent, a full explanation for this failure, along with a full and immediate response to the appeal I submitted on 8 February.

3. Confirmation that the charge has been frozen pending proper review of my appeal.

4. A full investigation into your handling of this matter, and your failure to meet your obligations under the BPA Code of Practice.

Please treat this as a formal complaint under your internal complaints procedure. If I do not receive a satisfactory response within 14 days, I will escalate the matter further through the BPA and other relevant bodies.

I have attached the original PCN, my appeal submission, and other relevant documentation for your reference.

I've received the first letter from debt recovery today. I nudged the BPA for a response 8 days ago but I still haven't heard back from them. Not quite sure how to progress this :-\
