Sure, I edited the original post and attached photos of the PCN along with how far I parked away from the notice. It's about five or so bays away.

I last checked on Saturday 4th, but since it's getting darker earlier I missed the sign - otherwise I would have moved it across the road. I'm not sure when they put the notice up.

On 07/01/26, I received a PCN for parking in a bay that was temporarily suspended. I am resident so typically park on this road but a set of these bays were restricted due to temporary road works.

I did not see the restriction and wanted to see if there is a possibility for an appeal here?

I would accept a bet of £100 that they will discontinue. If I had to put odds on the chance of this ever progressing as far as a hearing, it would be 1:1,000.

I'll submit the appeal this week and see what they respond with. My plan is to get hold of the CCTV if the gym have it, otherwise I'll just attach my attendance as proof for the appeal.

@b789 assuming I go down the route of appealing against ECP, does your advice in this thread still apply here?

Specifically, if it ends up going that far, does this ‘DCB Legal will discontinue the claim before they have to pay the trial fee’ still apply?

Try with the gym. ECP are only interested in your money.

Popped over today and they're saying they don't have anyone they can contact. They used to have a lot of these issues but now since the ECP issued machine is in the gym, it's all out of their control.

I'm going to contact the manager to try and get hold of the CCTV. The staff member I spoke to said that I can try and do that and then use that and attach to the appeal.

I'm aware of this gym. If you can show you attended the gym that day, you may get it reversed. The Gym have a tablet that customers are expected to use to enter their registration plates, and that gives 2 free hours. many people forget to do this. I was once done by this, but by that time they didn't even have the tablet working, and the gym tried to fob me off that it wasn't their responsibility.

at that time, somewhere on their website had "free gym parking", which is what I used to throw back at them, and they got the ticket cancelled on my behalf. I don't think that wording is on the website now since they installed the Tablet.

Oh nice, good to hear you had it reversed.

Do you think it's worth me pushing with the gym staff to get someone there to cancel it on my behalf or just appeal myself with the proof that I was there that evening? Getting hold of staff there seems tricky and they've already been quite unresponsive in getting hold of a manager.

So the staff member said that they don't know who the owner is for the retail park, but I'm going to speak to the manager to see if I can get anywhere.

They did however mention that this seems to be a common occurrence for some of the members. They received tickets but had them reversed after appealing by proving their attendance for that day.

Better to find out than to imagine - if the gym are no help, find out who owns the shopping complex and try with them. It is by far the quickest and easiest way to get the charge cancelled, so worth the effort.

The app shows history for attendance so I suppose that stands as good stead for an appeal (if it comes to it). I'll try to find out who owns the car park but a quick google search seems there isn't a central management agency (or a way to contact them) and they've just outsourced the parking management to ECP.

A fair proportion of the ECP charges we see on here eventually end up with a court claim initiated by the rather incompetent DCB Legal - if defended, they are pretty much always discontinued before they ever reach a hearing.

Sure thing, I've edited with the full notice and added the parking sign in the original. It's free for anyone (including non gym members) between 6am-10pm but post 10pm is when they'll charge. But regardless, as a gym member it's free from the moment you enter the car park for a few hours.

I'd imagine the systems are connected on the backend so not something they actively manage or have control over. Have messaged them nonetheless.

I want to understand what the options are here with respect to appealing if they cannot do anything about this.

On 02/05/2025, the driver of the vehicle entered The Arena Shopping Complex car park at 22:05:18 and exited at 22:30:56 according to the PCN. The notice alleges that they overstayed the maximum time period allowed and has now been hit with a £100 charge (discount to £60 if paid by 27/05/2025).

However, the driver is a member of the gym, which gives free parking to members (provided you enter your vehicle registration in the machine inside). They are sure entered on arrival but the PCN suggests that didn’t happen.

@b789 I noticed you mentioned in a similar case (https://www.ftla.uk/private-parking-tickets/euro-car-parks-pcn-overstayed-the-arena-shopping-park-harringey/) here that if it comes to it, an appeal and a long game of ignoring will be sufficient?

Based on comments in the thread, I just sent an appeal letter directly with the image of the PCN receipt paid at the pound all in (text here) to the address as a means to challenge. They responded saying it is too late to appeal:

@stamfordman - yeah it's something I need to think about. With or without a discount it's just a lot of money quite frankly that I don't have. Yeah I'm really hoping they'll see that the vehicle should have been removed earlier and they show some discretion in removing some of them and keeping others reduced. Based on all the thread comments, I think there is a legitimate case here for some fairness to be exhibited.

I'm just not sure if it's worth paying for PCN 1 and then taking the others to the tribunal? In my view, paying for the first does demonstrate that I did make a mistake in not seeing the email (irrespective of my general issue with council communications around permit reminders) and this is taking ownership of it. But then hoping it further pushes the case that PCN 2-13 essentially all refer to the same contravention and their issuing is an unreasonable response.

@Enceladus - yes, so this is dealing with 13 PCNs. The 14th one I am appealing separately, as I didn't officially receive an NoR for that and @cp8759 is helping me out with that one.

I've received a total of 13 NoRs and they all for the 13 PCNs and not the pound one.

I was abroad when my sister called me when she was at the pound getting the car released. They provided a print out of the PCNs as I requested them to do so via the phone, as I wasn't aware of any of them. I then proceeded to go onto the Haringey website and submitted the initial appeal one by one for each of them. It was a somewhat generic appeal and this was before the NtO stage and before I posted on this forum. I only posted on this forum when all 13 had progressed to the NtO stage as at that point I learnt about this forum from a friend.

The missing NtOs did not turn up and they never clarified why in their response. Also the copy they have given in response is the same copy on every one of the 13 PCN NoR letters.

Yes, they all arrived last Tuesday/Wednesday. I decided to open them yesterday as I knew I would need to set aside an evening for this and haven't had a chance since then. 11 of the 13 PCNs have been issued on the 21st and the rest have been issued on the 23rd.

The main advice of this forum is never opt for a decision on the papers alone; these usually end in disaster.


Can you clarify what you mean by this?

And that's good to know! The telephone hearing sounds like a much more convenient option.

Okay all, it's been a while since I posted and that's because Haringey have taken their time to get back to me.

The short and disappointing news is that they have rejected every appeal and now all the PCNs (13 of them) have progressed to the Notice of Rejection. This time I have received the letters for each one and they all give the details as to why they were rejected. They simply mentioned that I should have been aware of the expiry date of my resident permit, that PCNs may have fallen off due to adverse weather conditions and some filler text about being offered the initial opportunity to pay the reduced fee.

They did not address the lack of delivery for some of the Notice to Owners, the suggested argument for continuous contravention being applied here nor the email I received from the Head of Highways and Parking at Haringey Council, wherein she said that vehicles are typically removed after 3-5 PCNs being issued.

I've attached images here of one of these in order to not flood the entire post with the same copy across all of the PCNs. I have omitted the other pages which are just the forms to fill in to progress this.





As a reminder, I submitted two different appeals.

For PCN 1/13, I tried to appease to their sympathy that I did not see the email. It turns out it arrived into my junk folder and my email client did not pick up on this. I had to go onto GMail to locate it.

For PCN 2-13/13, I use the argument of continuous contravention.

My thoughts/questions:

1. I am considering paying the reduced fare of PCN 1/13, as it was my mistake. Thoughts on this?
2. Despite the reduced rate being offered for PCN 2-13/13, I think it makes sense to appeal this further. @Enceladus also mentioned in the previous post that are some discrepancies in the photos of the PCNs. I will look to see if there are anymore and build the case off this + continuous contravention.
3. I've not done this before so for my understanding, I am assuming this is now going to progress to a hearing where I will need to attend court?
