Author Topic: Coventry City Council: PCN parking in restricted street during pescribed hours  (Read 757 times)

I was issued a PCN on the 10th at Coventry Market. I parked my car in the early hours of the day and went to do some shopping in the market, on coming out the market, I saw that I have been issued a pcn.

Contravantion 01.

I searched Google and found that it means either parking on a double yellow or single yellow line during prohibited hours.

I have attached pictures of the bay I parked.

I wrote to the council as I was confused. I didn't park on the disabled bay neither was where I parked says restricted.

I have attached their response below

Please note that all the bays in that lot that says disabled had a disabled sign on the bay or a signage on the gate fence behind each bay.

I feel this is an unfair PCN but if anyone knows better, I am happy to learn.

First off, please post all of the PCN, both sides

As they say in their letter, the whole of Coventry City centre is a special parking zone, with signs telling you at the various roads in. You should have passed one of these on your way in :-

Basically, the zone restricts parking to marked bays only and there are no single or double yellow lines to indicate no parking elsewhere, as explained in their letter of rejection.

HOwever, your situation is that you didn't park in a bay at all, but on part of the cross-hatched area indicating no parking. However, you are also caught by the overall parking zone restriction that allows parking in marked bays only.

Once we see the PCN we can look at it for fatal errors of content, but I don't think you have a strong case if you take them to adjudication.

The location on the appeal (Retail Market (Circ Road)) also doesn't appear to correspond to the location the PNC is issued, which might be an possible point, but this may not be the strongest case or avenue I will admit.

Note to self - map tile Q24 contains the restriction, Cov don't seem to have published this with the order however

@Kingoj we have a very strong track record of getting PCNs cancelled, even ones that at first sight seem like a lost cause, but we cannot work with just snippets of information.

Please read the guidance here and post up the PCN, for all we know their evidence might not prove any contravention at all.

Hello, I made the payment already. Was worried i might go past the 28days allowance for half the payment.  I hope i dont get a PCN anymore but fingers crossed and will be visiting the forum to acquire more knowledge on PCNs thank you.

That's a shame as challenging the PCN usually results in the discount being extended anyway.

I didn't know that. I was thinking it wouldn't. Thank you at least I know now.
