Unfair ULEZ charges

Hi all,
Just wondering if I can get advice on this.
I’ve been wrongly send ULEZ penalty charge notices since September 2022.i have send them all the document to prove my vehicle is euro 6 and ULEZ comply.but they continue to misread my private number  plate and send me notices and then fines were accumulated over £4000.(now it’s nearly £7000)TFL has poorly trained staff and no coordination between them.during this period I’ve made legal representation to prove I’ve haven’t done anything wrong and send them PE2,PE3 aswell.but they were all refused and February 2024,they asked me to pay the full amount for 14PCNs they issued.and gave me a option to appeal costing£275 for each PCNs.when I was consulting a lawyer,gentleman on one of the forum ask me to contact my local MP.finally he email to TFL and they have cancelled all of them except two,withing  two days.after he email to TFL again they have cancelled the other two aswell saying system error.im a cancer patient and has high blood pressure.over these 1 1/2 years,this has made a huge impact on my health.i did not received even appology from TFL.so that i strongly feel that i should sue TFl for financial loss,mental and physical distress and data breaches.they have unlawfully obtained and processed my data.they have send Bailiffs twice to my address.
Please I would kindly ask your advice on what action should I take.

I don't think going into litigation straightaway would be wise as you'll need to instruct solicitors, and if you lost your case you have costs to pay, and these can soon add up.

Why not raise an official complaint with TfL, then, if given the Bum's Rush, complain to the Local Government Ombudsman for a clear case of maladministration.

I agree - you need to exhaust the official complaint process first, unless you want their solicitor's first question in court to be "why didn't you make an official complaint so we could sort this out without loads of legal fees?".

Another option (depending on your desire for revenge, political slant and opinion of the gutter press) would be to go to the Daily Mail, I'm sure they would jump on up a chance to brand Sadiq Khan as an evil anti motorist monster in the run-up to the Mayoral Election.

What does that actually mean?
Did you appeal any of the PCNs to tribunal?

You also mentioned you tried PE applications but why was that needed?
The circumstances have to be write and such forms have to be very focussed on relevant matters. You haven't shown any examples?

Neil, I suspect (Danson23 please confirm) the OP meant to write continued and that all PCNs have now been cancelled.

Danson, please confirm you are no longer getting ULEZ PCNs.

If that is the case, as others have advised, pursue your case through the official complaints process first.

Thank you for all your replies.i have complained to TFL previously (before all my PCNs cancelled)twice but haven’t had any reply or no investigation has been done.i have the proof for these complained.but these two occasions i never mentioned that I am seeking compensation.after i have emailed all the evidence to my local MP he had a discussion with TFL and now they all have been cancelled.if it wasn’t my Local MP(I don’t know him personally)I would have to pay huge amount of fine.
I had a private number plate starting OO03 and cameras were misreading the VRN as a 03 number plate.this was admitted by the TFL.but despite of my evidence, because of their system error they continue to court proceedings.they seems to ignore my legal representation that’s why I had to fill the PE2 and PE3 forms.someone with right mind could have easily understand with all the evidence that I did not break the law here.but these all computer readings.

It is NEVER necessary to use both forms unless you failed to respond to notices at some point. And you still haven't shown us an example.

Tell us the whole story rather than what you think happened.

So they weren't misreading the plate. That is a 03 plate. (If they were actually misreading the plate how could they possibly have associated it to you?).

I suspect what you really mean is that the database entry associated with that OO 03 xxx plate showed a non compliant vehicle (which was actually compliant).

There are certain issues (which depending upon your point of view may or may not be TfL fault) with ascertaining compliance and it is an imperfect system.

Factors around this involve whether or not the vehicle was constructed against a specific euro 6 standard (assuming it is diesel) and when.

These issues occur because the only registered information may not be definitive dependant upon the actual date of the vehicles registration and when the plate was transferred (if indeed it was rather than being assigned at first registration).

The NoX figure is what matters (and in certain cases the particulates). These may be recorded dependant upon date of your V5c (there are variants of these).

A redacted copy of your V5c may help, but only in ascertaining whether TfL should have known it was compliant.

There is a process documented on TfL website which they expect people to engage with for challenging a vehicle and updating its records. I assume you didn't engage with it (which could simply be because it is poorly publicised).

It may be the case that TfL haven't been negligent. That depends to an extent on how you responded to the PCNs etc.

When I received my first ULEZ penalty charge notice back in September ,I straitaway paid the fine as my vehicle was not registered.then I send TFL v5c for private plate and the certificate of conformity from VWF golf.layer stage when they said about this misreading I send them v5c for original number plate aswell.so they had enough time to figure out this is the same vehicle.back in October 2023,i change the plate to its original plate but they still continue to send fines for original plate aswell.when I appeal for them,they have cancelled them only.

You haven't really provided enough information to provide meaningful responses.
What is the make and exact model of the car?
The month and year of 1st registration?
Is it UK spec or an import?

And post up one of the PCNs, preferably the oldest that's not yet cancelled. Please redact only your name and address. Please leave everything else visible including the PCN number, the vehicle registration, all location info and all dates and times. As per the Instructions are in the "READ THIS FIRST ......." sticky post at the top of page 1 of this Forum.

...because of their system error they continue to court proceedings.
Have all the PCNs been cancelled, or are they continuing enforcement proceedings? It's got to be one or the other.

Why is it not possible to charge TfL with attempted fraud? Why should I suffer harassment and anxiety over an illegally issued PCN? Why should I not be able to invoice them for the time I have been having waste over responding to a PCN that should never have been issued for my ULEZ-compliant Euro 6 vehicle driving down the Old Kent Road at 9.15am on a Saturday? Is it my fault if they are so incompetent they cannot update their database for a number plate change registered with the DVLA a week earlier?
