Yellow box infringement - tfl - sw18

Car pulled in front blocking us after we’d started moving through the yellow box

—————-

Hi there

Wondering if anyone can help. Back in December my mum got a fine for a yellow box infringement. She went to move across the box (the exit was clear) but a car pulled out in front of her blocking her path and causing her to stop in the junction. There is no way she could have foreseen this car pulling out - I was in the car with her.

We appealed the fine, fairly quickly. We didn’t hear back so we wrote to TFL to enquire. We got a letter back saying they had responded with a copy of the letter declining the appeal - we absolutely had not received this.

we then decided to appeal to London tribunals. We send the appeal but got a response saying we were out of date (because we’d not received the letter in time).

We also had to send something to tfl signed by an officer of the court to say we had appealed to the tribunal. We got a response back saying we hadn’t filled in address (correct) and it was unclear who witnessed the signature (even though there is the company stamp from the law firm and the name of the person signing is crystal clear. The whole thing seems absolutely ridiculous and is stressing my mum out as it now stands at £240 which is a lot for her.

we want to fight it because it seems incredibly unfair but not sure what to do next. Can anyone help?

Thanks so much, you are all legends

Sorry, but you need to post up the documents and letters.

We particularly need to see this document: -

Sorry I tried to post them but they’ve not rendered for some reason. Does this link work?

Yes it does, and I'm puzzled why TEC say it's not clear who your witness is, maybe they want something that says "solicitors and commissioners for oaths" against the solicitors name and address, as the form says. Your address is blank, so you need to put that in and resubmit.
