TFL red route PCN - Stopped for a minute (Appeal rejected)
« on: »
Hi everyone,

Hope you all are well.

I had received a Penalty Charge Notice from TFL for “stopping where prohibited (on a red route or clearway)” — contravention code 46.
Location: Outside 29–31 Stoke Newington Road, N16
Date/time: 12th October at 17:49

I stopped briefly (under a few minutes) to load goods, in what I believed was a loading bay. Since it was a Sunday and I was in the usual 7am-7pm loading exception for nearly everywhere else, I thought that loading in the bay was fine. Senseless mistake on my side. I believe I stopped confirmed the restrictions (due to it being dark) and thus left within a minute as noted by TFL on rejection letter.

I appealed telling them the same scenario and received the rejection this morning. The noted the only observed me stationary for 1 minute (noted on letter). However in the letter I think (May be wrong) that they made a mistake. The claim the signage indicates 'no stopping Mon-Sat 7am-7pm except 10am-4pm for loading'. However on the signage it is actually no stopping at any time except 10am-4pm for loading, except taxis 7am - 7pm.

I am therefore asking here if I have any chance at an adjudicator appeal or should I just pay up for this mistake?

Thank you for your advice :)

I practice law in the Traffic Penalty Tribunal, London Tribunals, the First-tier tribunal for Scotland, and the Traffic Penalty Tribunal for Northern Ireland, but I am not a solicitor or a barrister. Notwithstanding this, I voluntarily apply the cab rank rule. I am a member of the Society of Professional McKenzie Friends, my membership number is FM193 and I abide by the SPMF service standards.

Why would the exempted parking area be in respect of a 24/7 Red Route restriction when the restriction fore and aft is SINGLE red line 7am-7pm? It doesn't make sense.

My initial appeal was rejected. I then appealed to London Tribunals and TFL pulled out before the hearing. Justice served.
