Penalty charge in town centre

High Wycombe County Council have served me with a penalty charge for parking Roadside in the town centre, as I was new to the area and visited at the time of getting penalty, no yellow or redline on the road and no sign of "No Parking".

Any advice on my right to appeal the Penalty change ?

It seems you drove into a pedestrian zone, with no parking and no loading restrictions

Something's odd here.

The only way you could be within a correctly signed ped zone with waiting restrictions is if there weren't any yellow lines marked.

But there are.

There's a clear set of DYL just ahead of your car.

This combination is only permissible if at the point at which they start the ped zone ends and is signed with a Zone Ends sign.

There's no such sign in their photos as far as I can see.

The zone entry sign is correctly signed with the no waiting panel although Maps is from 2019.

Also I think you came from another direction - where from?

There shouldn't be yellow lines extending into the zone, and the no loading pic taken by the CEO should be combined with a no waiting repeater sign I think.

The signage is contradictory.

The council want to rely upon no markings and a 'No loading' traffic sign.

IMO, this combination is only permissible within a Pedestrian Zone(although Restricted Parking Zones also exist without markings, 'No loading' is indicated on the gateway sign NOT an upright traffic sign).

But it cannot be a PZ because:

There isn't a sign in evidence, and
The OP was parked adjacent to DYL without there being any 'Zone Ends' sign at the location.

OP, it is the authority's burden to prove the contravention. Without a PZ sign in evidence they haven't, all they've proved is that because the otherwise mandatory road markings are not present the contravention did NOT occur.

IMO, what becomes evident from this plan is that there's only one pair of PZ signs in view; they do NOT prohibit waiting*; and that they're wrongly placed because you cannot have DYLs in a PZ.

OP, what was your route to where you were parked?

It was not a one way road and I went on the other side by checking all the roads to see where I can park for a while to buy ice-cream and was visiting the town only, not been there before

I am going to appeal now by putting these points in my mind.

I refer to your recent correspondence in connection with the above Penalty Charge Notice (PCN).
The PCN was issued for parking or loading and unloading in a restricted street, where waiting and
loading and unloading restrictions are in force. This is an instant ticket, and no observation is
required.
You have stated that:
1. My Vehicle Was Not Parked on a Double Yellow Line
2. No Signage Indicating Parking Restrictions
3. The Area Cannot Be Deemed a Pedestrian Zone
4. Contradictory and Confusing Signage
5. No Road Markings Indicating Restriction
 Queens Square, High Wycombe is within the Town Centre Pedestrian Zone and there are signs
at the junction of Oxford Street and Queens Square which advise the driver “No Vehicles”
“Except Buses and Access” and “Traffic Enforcement Cameras”.
The road surface is paved to indicate it is also a Pedestrian Zone. There are also “No Loading”
signs at intervals on street. Vehicles are not permitted to enter Queens Square unless they are
accessing private off street parking or loading bays and vehicles are not allowed to park on street
within the Pedestrian Zone.
Signs advising the driver they are in the Pedestrian Zone are situated at the junction with Church
Street with Queens Square, and advise “Pedestrian Zone”, “No Vehicles except permit
holders”, No waiting at Any Time and No Loading at Any Time.

It is the drivers responsibility to be aware of the signs at the entrance to Queens Square which
prohibit entry to vehicles.
Having considered the circumstances, I must advise you that you have not provided sufficient
grounds for cancellation of the Charge. The Council is satisfied that the PCN was issued correctly
and that payment is now due.
The Council is willing to accept the discounted amount of £35.00 providing payment is received
within fourteen days of the date of this letter. Failure to pay within this time will mean that the
discount offer expires and the full amount of £70.00 will become due.
If no payment is received, a Notice to Owner will be sent to the registered keeper of the vehicle as
provided by DVLA. This will allow that person or their authorised representative to submit a formal

I have received reply on email yesterday with the letter attached as above copied . Haven't received any letter physically
