52M contravention

Could you please advise if I should write a representation? I couldn't find the location on Google Maps, and the name of the road brings up a different place, so I couldn't review the signage. It's not a place I drive often, so please advise if it would be better to pay the fine. Thank you

For me, this is the most appallingly implemented restriction I have ever seen in my time posting on forums, and that is well over 10 years. H & F seem to have recognised they have made a complete Pig's Ear of the thing, because most people that submit reps get the PCN cancelled.

(1) There is no meaningful signage on the 40mph Great West Road. This is a dual-carriageway and only a left turn can be made into the street.

(2) They have placed the signs right a the start of the street, so if one sees the signs when turning into, and stop,  it is super-dangerous to reverse out onto the A4.

The restriction is to prevent the street being used as a rat run to the King's Road. I they wanted to acheive this, then putting the signs a few yards back from the street entrance would allow motorists to see the signs, turn round and then rejoin the A4.  But of course this would reduce their income from PCNs !  The sheer wickedness and venality of this council is well known, and one suspects that the reason they cancel PCNs here when reps are received is to avoid the matter coming under notice at London Tribunals. Of course we only see about 5% of PCN recipients here so it is a "nice little earner" for the council.

Please note that GSV does not show the signs, because the restriction was imposed after the last view here, (September 2024).

There are a number of successful cases here on this forum, so you need to search using "Rivercourt Road"

Dear Sir/Madam

I am writing to request to cancel PCN issued to me, which I believe was unfairly issued due to the following reasons:

1.Inadequate and Insufficient Signage:
 There were no clear and visible advance warnings on the A4 before reaching the exit to indicate the prohibition. Given that this exit has been unrestricted for years, the council should have ensured clear and noticeable advance warnings before the junction to allow drivers to take an alternative route safely.

2.Recent and Unexpected Changes to Restrictions.
This was my first time using this road, and I was unaware of the new restriction. The lack of prior warning to users of this route causes confusion, especially when appearing alongside with numerous  other road signs, which was the case on this occasion.

3.Highway Safety Concerns.
 Upon exiting the A4, I was immediately presented with multiple signs at a location where it was unsafe to stop and read them properly. There are approximately ten signs at that exit, including speed restriction, parking restriction, two camera signs, two one-way signs, lorry sign, lorry entry times and dates, and road name. The complexity of signage at the junction made it difficult to process the restriction in real time, particularly while navigating a busy exit. Additionally, slowing down at the entrance in an attempt to read the road signs would create a dangerous situation with fast-moving traffic on the A4.

4.Alternative Actions Were Unsafe Once committed to the exit, reversing back onto the A4 was not a lawful or safe option due to Highway Code Rules 200 and 201. The council’s restriction forces drivers into a situation where they must proceed, making enforcement in such cases unfair and unreasonable.

5. Reliance on Navigation Systems.
Government Measures for Accurate Sat-Nav Information Since January 2024, the government has launched new measures to ensure drivers receive accurate information from their sat-navs under its new Plan for Drivers, where all Traffic Regulation Orders (TROs) are updated to prevent misdirecting drivers. My car sat-nav did not detect the road as a restricted area, suggesting that the decision about the restriction imposed on
 I was following the navigator while visiting an unfamiliar area and appropriate signage would assist drivers in case sat-navs are not updated despite the Government’s  promised measures regarding sat navs updates.

6.Hazardous Turning Circle.
Furthermore, the potential ‘turning circle’ to turn back onto the A4 appears to be a very dangerous notion on such a busy road and, even if room for such a manoeuvre existed. The current arrangement is clearly noncompliant with Highway Code Rule 201, as it requires a reversing manoeuvre into the busy A4.

Request for Consideration In light of the above.
I respectfully request that this PCN be reviewed and cancelled. The lack of advance signage, the unexpected nature of the restriction, the complexity of signage, and the hazardous turning spot contributed to the unavoidable situation. I would appreciate it if the council could exercise discretion and consider either cancelling the charge or providing further guidance on improving signage to prevent similar incidents in the future.
