PCN on disabled badge

I’m a disabled badge holder and I parked in a designated bay, displayed my badge correctly, but forgot to set the time disc. I actually parked at 2:30pm, but the clock was still set to 5:00pm. (Parking is free after 6:30pm.) I received a PCN for this.

I appealed to the council and attached a letter from my solicitor confirming my 2:30pm appointment, but they rejected the appeal. I now have two options:
  • Pay £80 at the discounted rate, or
  • Wait for the Notice to Owner, risk the full £160 fine, appeal again to the council, and then take it to the independent tribunal if needed.

My question is: Is it worth appealing further, and what are the chances of success?

You need to post the PCN together with the photos so they can be reviewed.

No need to redact VRM and PCN number, pl reinstate.

We need a GSV to the location to confirm that you were in an unmarked and not marked parking place.

The PCN means you were parked in a Permit Parking Area, marked by at least one entry sign.

“permit parking area”

an area—
(a)
into which each entrance for vehicular traffic has been indicated by the sign provided for at item 5 of the sign table in Part 3 of Schedule 5; and

(b)
where any parking place within that area reserved for the use of the permit holders as indicated on that sign is not shown by markings on the road (whether or not an upright sign is placed next to, or near, such a parking place to indicate that only the permit holders in question may use the place)


The sign in evidence is meaningless on its own, other than to show that a contravention did not occur because on its own it has no legal effect without corresponding road markings.

Are you the registered keeper with current DVLA details?

Sorry for the questions, but we need to see the council's evidence to do which we'll need the PCN etc. details.

I can just see what looks like a 'Permit Area Ends' sign in the background and GSV show a Permit Holders Only sign which you must have passed. Did you?

If so, why do you think that a BB allows you to park in a permit holder's bay in this council's area? Have you done this before?

Yes, I have done it before. Actually, the PCN was issued because the time displayed on my Blue Badge clock was incorrect. I parked at around 2:30pm, but the clock showed 5:00pm, which led to the ticket being issued — although this reason was not stated anywhere on the PCN itself.

My question is whether this can be contested, as the incorrect time was an honest mistake and not an attempt to mislead the inspector, especially since parking is free after 6:30pm.

You are mistaken.

From the BB booklet:
Places where you cannot park

Parking places reserved for specific users such as resident’s bays or loading bays. You may wish to check whether a particular local council has chosen to exempt Blue Badge holders from these restrictions.

A BB does not entitle you to park in a permit holders only parking place. However, local authorities may choose to allow this.

So your premise is wrong and therefore possibly your assumption that the issue at large is failure to display a parking disc in the required manner. For all we know, you'd have received a PCN anyway, clock or not, because you're not allowed to park there with a BB anyway.

Hence my questions.
My request for PCN number and VRM are outstanding.

It is clearly stated on the Redbridge website that Blue Badge holders are allowed to park in resident permit holder area. Also, please let me know what information is missing here that would need to be taken directly from the PCN in order to provide proper assistance.

Thanks. I don't know whether Redbridge use 'resident permit' and 'permit' synonymously (the are separate and distinct prescribed traffic signs) but if they do then presumably the permit identifier here means resident permit and their policy applies, in which case you are correct in that failure to set the clock correctly gave rise to the PCN.


As regards further info, the authority's response, the VRM and PCN number please. Also confirm whether you are the registered keeper with current DVLA details.
