I went to see my mum who has mobility issues and a blue badge issued by Hounslow Council (HC) and my brother who is autistm and had to park like this as I was due to take her out for the weekend (I have evidence of bookings) but she she was feeling unwell. She has has multiple health issues, gp and hospital visits quite frequently. My mum lives at the adresss in question, so I parked like this in an emergency. There  was space on the pavement for someone in a wheelchair or pushchair to safely pass. The pavement is wide and much bigger than it looks in the picture.

My brothers and sisters cars are there and they cannot move anymore to give me space and they were not home anyway so they were unable to to move their cars. What you cant see is a huge telephone post in front of the drive so this is the only way for me to park and reverse safely.

 I needed to take my mum to the hospital and it takes her a while to safely get in and out of the car. I had my brother with me too and he has no independent road safety skills as he has autism. The road I reverse into is very busy so need time to get them both in safely and this is the only way.

The main road is narrow and buses and cars pass on either side, and there are cars parked at the side of the road and they need to stop to pass. I once parked sideways on the pavement on the dropped kerb but it blocked traffic. In the picture taken there is a car parked across the road so I would have blocked traffic and this was my only option in an emergency There are cars parked down there Benedict Drive and along hatton road, you have to stop before that road or you can't manouvere out safely as usually and on that side of the road there are cars parked immediately after or you can't get out. Cars can get by  if I parked on the dropped kerb but not double deck buses which frequent this road.

There is no pay and display and the other place to park across the road had no space as that is my only other option.

I saw someone as I came out but was too late as I didn't realise I was getting a ticket he had a hi vis jacket. The time I took the picture was about 5 minutes or so after leaving the house. He must have seen me and my mum coming out of the house but she walls slowly with a stick and physical support from me, she cannot go out alone independently.I took the picture about 5 minutes after my mum was in the car it was really hot so couldn't leave her and chase the guy.

Can I ask for discretion to cancel this PCN as I tried to park safely in the drive in the designated parking place  and it was a medical emergency.

OP, IMO you've spent more time canvassing opinion regarding prospective parking options than dealing with the PCN.

Of course the authority said no. You did not have a statutory defence, simply a range of mitigating arguments. You are only a party to this matter until a Notice to Owner is served on the registered keeper because liability rests with them. This could be Enterprise or perhaps even a leasing company.

So we're likely at this stage of the process: 'Enterprise are poor at dealing with NTOs which would heap confusion on the whole process. You could play the game, but not without some risk.'

Are you the hirer of the vehicle? If yes, then you are liable to Enterprise contractually and prospectively financially.

Unless the PCN is paid then the registered keeper would be served with a NTO. If you're the hirer, then you know your contractual liabilities and Enterprise's options.

Can we get back to this PCN and Enterprise pl.

So wait for enterprise to serve me notice then the council in turn.Them appeal again, get told no again then pay. With emergency parking how can you appeal the decision?

Enterprise won't 'serve' you with a notice, IMO the options are that:

1. they might copy you in to correspondence addressed to the council notifying them that you are authorised to act for Enterprise, or

2. They make representations under the 'hire company' grounds(which would give you statutory procedural grounds of representation), or

3. They simply pay the penalty and recover this from you contractually plus any admin. fees permitted.

IMO, your argument about not being able to park elsewhere goes to mitigation only, it is not a statutory defence and would not be considered by an adjudicator, should matters get that far.

IMO, the only positive action open to you at this stage is extra-procedural i.e. notify Enterprise (what you tell them about the events, I leave to you) and find out what their likely response would be.

Hi all,

Right want to do this with very little headache as enterprise tend to go around and circles.  Enterprise have sent me the fine but I thought that I had a chance to pay every juice rate set.Am I confused as to why I would be paying the full rate. Is there a better way to approach this with them because I know it is going to be a headache, but they usually pay the reduced amount so i'm very surprised.

Just a few things you may ask.

* Full rate is £160 reduced is £80
*Admin charge is £30
* Notice to owner was sent two days after this happened to Enterprise so could have paid the reduced rate.

Just reading again that I can make an appeal when they send the NTO in my name which iv'e not received and there is a chance for further appeal after that if I am not happy with the results. I assume you will say it is not worth it

Post what you have received. Delete only personal info but tell us if it's addressed to you by name or Enterprise.

The PCN is addressed to Enterprise, so unless they submit representations that they are a hire company and provide your name and address, you cannot appeal the PCN. We very often see this with hire companies, especially the larger ones who don't want any complications. It is much easier for them to pay the PCN and off-charge it to the hirer, kissing it up the ass with an admin fee , of course !!
If you look in their conditions of service you'll likely find that you are liable for all parking and traffic offences.

Thanks, but my issue isn't with liability it's the more expensive cost they paid when they were notified in good time.

If the council do not resend in my name in  6 months for me to formally appeal could I challenge it then still when they reissue. But can't di that if I challenge the amount with enterprise

What you have is option 1 with a touch of option 3 thrown in, see my post #18.

Their letter is dated 21 Aug, you posted it today, 10 days later.

The letter states: We are notifying you ..that we will add the following charges[£190 being the penalty of £160 plus their admin. fee of £30] to your account in 7 days' time'.

The 7 days is up. Have they paid the penalty? If not, you may make representations on their behalf

Thank you I read your post #8 again don't think enterprise will care but it is worth a try. But will wait for now because you said in #8

They didn't copy me in but have stated in an email to me that I was the person hiring and I have authorisation to make formal representations. I think this means to appeal again, but as it has been paid by enterprise (not collected yet by me) can they reissue me with the original reduced rate as they said I don't have authorisation to appeal. Not sure what account enterprise is trying to collect from but it is empty, but don't want it to go to balifs whilst I wait for a reissue, but  £110 is a lot less painful than £190

You said it is unlikely to be accepted as a mitigating factor by adjudicators which is a shame as I would have tried.

My mistake with dates thought they sent it straight away to enterprise so they could have paid the reduced rate.

If I can wait for reissue for it to be out of time is it 6 months from original date of infraction or 6 months from when they send NTO (Enterprise).

Or will the council not reissue as it has been paid, forgot how that works. Thanks so much

According to the council, the PCN had been paid and normally the case would be closed.

You are trying to breathe life into it by making reps(on behalf of Enterprise) and the ONLY grounds available in law are these:


(d)the recipient is a vehicle-hire firm and—

(i)the vehicle in question was at the material time hired from that firm under a hiring agreement, and

(ii)the person hiring it had signed a statement of liability acknowledging their liability in respect of any penalty charge notice served in respect of any relevant road traffic contravention involving the vehicle during the currency of the hiring agreement;




“hiring agreement” and “vehicle-hire firm” have the same meanings as in section 66 of the Road Traffic Offenders Act 1988

So, do you still have the docs issued by Enterprise when you hired the vehicle and which contain what is specified in this Schedule?

Thank you.

I am locked out of my enterprise account because they couldn't take the payment. If you mean the contract I signed it is liklely in the account. I will scheck my email. If can't find it I assjme the lettertenterprise wrote to me recently is not enough evidence to send?

If that doesn't work how can I pay the original charge, do I go to enterprise or Hounslow?
