Merton Borough, Being in a Bus Lane Contr Code 34J. Video recorded

Hi,

As per videos, image uploaded (https://imgpile.com/p/zyQnvBz), I was driving and clip the end of a bus lane right at the END of the bus lane section. I am of the opinion this is in the normal course of driving, had no impact on other traffic or road users, and was not fully "in" the bus lane, but changing lanes very marginally prematurely (within normal driving tolerances) to place my car in a valid driving lane. 2 wheels are for a very short time over the white line.
While the end of the bus lane is not shown within their camera angles, the Google street view links provided below show that the end of the bus lane is imminent. Links to the street view are also attached below.

I have not contacted Merton Borough yet. The letter is dated 10th July, and received by me 11th July.

Any advice or help you can provide to challenge this PCN would be greatly appreciated and I am grateful you have taken the time to read my case.

I make it that you were in the bus lane for 17 metres. This would ordinarily be considered de minimis at London Tribunals, but it's not a guaranteed win, I'm afraid. You must emphasise that no advantage was taken of other road users as the video shows.

Needless to say the council will reject your reps because they only want your money, there is no traffic management purpose in enforcing such trivial offences. Indeed they are being as mendacious as the possible can by not showing the end of the bus lane in the video. The end is actually the sign in the video that you can see the back of at the bottom of the camera view.

There are "known knowns" which we may never have wished to know. This applies to them. But in the field the idea that there are also "unknown unknowns" doesn't apply as they hide in the aleatoric lottery. I know this is true and need to be prepared knowing the "unknown unknowns" may well apply.
