Lewisham Council PCM - Appeal - No visible signs

Hi Ftla community!

I hope you can assist me, I unfortunately received a parking, when parked in Lewisham.

I was confused to have received this ticket, as the parking warden told me that it was okay to park here, as the parking sign had been taken down, a few feet from where my van was parked.

There was a parking sign up the road, but this was quite a bit of distance from my van.

My vehicle is the black Van.

I now realise I made a mistake, when I did not get the parking wardens name, but I am able to describe her, and I can go back and try and get her name if required.

I wonder if you could please assist and please help me with my appeal.

Please provide a Google Street View link to the location as well as clearer PCN images from the Lewisham website (or confirm PCN number and Reg so we can check).

It's a long bay, and GSV shows two signs for it, the one you say is missing, and the one by the raised section of the carriageway further up. Both signs for the parking are identical, with the same bay code.
OK, there is a sign missing, but you are still under a duty to seek out the bay sign which is not far away at all being about 18 metres away.
YOu appear to have misinterpreted the CEOs advice. Yes, parking is allowed in the bay, but on a payment basis, unless you are a permit holder.

Hi Incandescent,

Thanks for clarifying.

The parking warden told me 100%, that I would be able to park there for free, as the sign has been taken off.

I am able to describe her, and can go back and try and get her name if required.

I had my friend with my, who is my witness.

However lesson learnt, don't listen to a parking warden.

Is this a parking appeal, that I have no chance in winning then?

Should I just pay the parking fine, and cut my losses?

Don't pay yet, until you have submitted what is called an "informal challenge" to the PCN. You should base your representation on what you have told us, and also mention that you have a witness who can confirm the conversation with the CEO. Don't be confrontational, just firm. Once you get a response, please post it here, and you can decide whether to then cough-up, (the discount will be re-offered, see back of your PCN), or take them all the way to London Tribunals.

Next enforcement stage is the service of a Notice to Owner. Are you the owner, and if so, is your V5C up-to-date, because the NtO is sent to the name and address on the V5C ?

Thank you! Ill get my appeal done today.

This is a company vehicle, so I am just the driver on this vehicle.

Will I need to notify them about this, and get this PCN transferred to my personal name?

Ah, but does your employer own the van, it could be leased ? Things get very complex when the PCN recipient isn't the owner. So you need to find out who owns the van and what happens when PCNs are received by drivers.

Yes my employer owns this van, with previous parking fines, we usually just tell the parking fine agency, who the driver of the vehicle was. Thank you

IMO,

Tell them?
I would* because they would be the recipients of a Notice to Owner requiring THEM to pay or challenge.

Get this PCN transferred to my personal name? They cannot. This applies only in the case of 'vehicle hire firms' where a 'hiring agreement' exists.

*- timing is up to you. You could tell them now and add they you're in the process of challenging for the reasons you've set out here. At least this would set the narrative should they subsequently receive a NTO.

All council and Transport for London Penalty CHarge Notices are issued under decriminalised legislation that allows councils and TfL to enforce parking and other minor traffic offences, (speeding is not part of this and remains with the police). All PCNs are the legal responsibility of the legal owner for payment or appeals, so your employer must grant you permission to act on their behalf when submitting representations against a Notice to Owner, or when appealing to London Tribunals. You would need a letter of authority to submit to the council when the NOtice to Owner is served.

This is totally different to private tickets which are usually called Parking Charge Notices, also "PCN" hence confusion about the difference is very common.

There are "known knowns" which we may never have wished to know. This applies to them. But in the field the idea that there are also "unknown unknowns" doesn't apply as they hide in the aleatoric lottery. I know this is true and need to be prepared knowing the "unknown unknowns" may well apply.
