Islington, 73 Paid without payment of the parking charge

Hi, my son parked in Sobwell Leisure Centre car park and went to the sign to find out how to pay. He had to set up his car on the app, as he is a new driver, paid and went in. On returning he had a parking ticket on his car. The time of payment is 11:27 on the app. The ticket was issued at 11:26. He appealed with evidence of the payment but it has been rejected. This seems very wrong to me, it would have taken him at least 5 mins to download and set up the car on the app, surely there has to be some wriggle room to pay for the parking before issuing a ticket?

Could I have some advice please? He would like to appeal this further.

Can you post the original PCN please.

You should repost the rejection letter without name and address if you're bothered about that.

This should win at appeal given the 1 minute difference but where was your son when he set up the app and made the payment - leaving the car is not great.

As they've not reoffered the discount there is nothing to lose by appealing and plenty of appeals have been won on time needed to pay.

It's the Sobell Leisure Centre - I got a PCN in that same car park ages ago, which I should have challenged knowing what I know now.

Time is allowed to pay for the parking, or nobody could ever park legally ! However the time taken must be reasonable in the circumstances, and here it all looks reasonable. So your son should submit representations that when he arrived, he had to first download the app needed to pay for the parking, then actually make the payment. His parking session was only one minute after the PCN time, so they should give way on this, but probably won't as all they can see is ££££ signs in front of them. So you son may have to forego the discount, and take them all the way to adjudication. It is this or just cough-up, I'm afraid.

Q: Is your son the name and address on the V5C Registration Certificate for the vehicle ? A Notice to Owner, the next stage in the process is sent to that name and address.

It's gone through NTO now at no discount appeal.


OP - did you challenge at first stage?

We need to see the PCN.

Not according to many councils it seems :( I've got a case on going in another thread, similar to an extent, having checked the councis parking guidelines, its a 0 minute observation, in other words a instant ticket, think Newham is the same also..

They're argument is its your responsibility to ensure a ticket is on before leaving the car, so in otherwords her son should have downloaded the app and set it up while in the car, then paid and left.

Seems like Islington are strict as they are not budging on the 1 minute even.
