Free Traffic Legal Advice

Hi. Hope everyone’s week is going better than mine! I’ve just returned home to find my second PCN of the week (albeit different boroughs). The first was a 52m from Hackney and the second a 53J from Havering.

The main reason I am writing is that after doing some basic research it appears that my 53J was issued based on me dropping my daughter to school, which I have done a few times over the past couple of weeks. My worry is that having just received this PCN dated 24/1 I will be receiving several more! I’m currently in the midst of organising my father’s funeral after his sudden passing and can’t afford to pay all of these (presumably incoming) fines. Can anyone help?

It was probably a left turn. I can see there are two pedestrian/cycle zone signs on the right and left sides of the road (settle road). I can see that now viewing GSV and looking at the council photos, but when using Waze to get to the designated parent car park, it never crossed my mind I was doing something illegal

1. There is no clear advanced warning signage.

2. I raise the issue of an inappropriate ground appearing on the PCN concerning a traffic order being invalid.  The PCN is unenforceable because it contains a ground referring to the traffic order being invalid which does not belong in this legislation.

3. Furthermore, there appear on the PCN two lists of grounds, which clearly do not agree with each other and, indeed, another wrong ground concerning the TWOC: The vehicle had been permitted to rest in the place in question by a person who was in control of the vehicle without the consent of the owner. – Clearly, this and the aforementioned ground belong to parking legislation.

In light of the above, please cancel the PCN

When you go onto their website, choose "procedural impropriety". Reason: to call their bluff as, if they reject saying that is not a valid ground (which it isn't!), then your case becomes stronger at the Tribunal.

But there is an advance warning sign in the geographical layout we prefer, rather than "blue signs". It is about 100 metres from the turn.

For me, this makes for a weaker case on signage.

However I think the OP will be on stronger ground on PCNs issued between the date of the first PCN, and its arrival, and those issued between those two dates.  Clearly the arrival of the first PCN was when you first realised the contravention, and how many times you had turned left there. Many councils will cancel these "middle of dates" ones provided the first one is paid, but they can play hard ball, I'm afraid.
