PCN- Parking where a temporary traffic order was in place


I live on a road managed by Haringey Council. The council put temporary parking restrictions in place to allow builders to carry out work in the area. My partner's car was parked in a safe spot, but one of the builders knocked on our door and asked my partner to move the vehicle, as they needed the space to accommodate their equipment and complete the approved construction project.

In good faith, my partner complied with the builder's request and relocated the car, but this ended up placing it in a restricted parking zone. As a result, we received a parking ticket. We have a neighbor who can corroborate that the builder asked us to move the vehicle.

However, Haringey Council has been resolute in pursuing the fine. We've now received two letters in response to our appeals, and they have even doubled the fine to £130. The next step is a Notice to Owner.

Given the circumstances - where the parking restrictions were put in place to facilitate the council-approved construction work, and we moved the car at the direct request of the builders - do we have a strong case to continue contesting this ticket? I want to understand our options and likelihood of successfully overturning the fine, before proceeding to the next stage of the appeals process.

Please let me know your assessment of our situation and any advice you can provide on the best path forward. I appreciate your assistance.

Also note that the "fine" (actually a Penalty Charge, this is civil law), has not doubled, but is now at the full penalty, the discount period has expired.

So if they now want the full £130, it is now a no-brainer to wait for the Notice to Owner, and submit your reps again. Once they reject again, (as they will), they may re-offer the discount. If they don't, then you take them to London Tribunals as there is no increase in the penalty and no additional costs. For them, they would have to pay the tribunal fee and also prepare an evidence pack and they don't like doing this, so even if you lose at least you've made them do some work for their money.

To the first responder if they did reduce the amount to half, would it be in our interests to accept this and pay up
Or see if we can have the whole fine waived ?
