Greenwich LTN - PCN help
« on: »
Hi,

I've got a PCN for entering an LTN in Greenwich (St Johns Park/Vanburgh Park). It is a timed low traffic neighbourhood - Mon to Fri 7am-10am and 3pm-7pm - so no physical barriers

I was on Strathdean Road and turned left into St Johns Park, which I've subsequently learnt is not allowed. It was about 6pm and dark with roadworks on Strathdean Road and we didn't see a sign at all. Being unfamiliar with the area, we were following the sat nav in the car which directed us this way.

The evidence provided with the PCN is of us exiting the LTN - so the signage facing our direction of travel which we would not have seen. There is no photo evidence of us entering the LTN.

From looking at streetview, there is one small sign on Strathdean Road but in the dark and with the roadworks we simply didn't see it.

Would welcome any advice on appealing. Should we mention all three things (following sat nav, lack of evidence and insufficient signage) or just focus on one? Has anyone successfully appealed a PCN with LB Greenwich.

This is where we entered the LTN https://maps.app.goo.gl/dTcT19gorPX2J2Ur6
But this is where the photo evidence is from https://maps.app.goo.gl/Ax5uZK4Ub8h4Skba7

Thanks!

Oh dear, oh dear, how often do we see this ! Don't put this in your reps, but concentrate on the signage issue. Councils have a duty under Regulation 18 of The Local Authorities’ Traffic Orders (Procedure) (England and Wales) Regulations 1996 to erect adequate signage for an restriction.

https://www.legislation.gov.uk/uksi/1996/2489/regulation/18

GSV of your approch to the signs shows you could have a case of obscuration of the signs:-

See 1st link in my profile re the PCN. Best to put something in as they tend not to contest at the Tribunal.
I REGRET THAT, FOR THE PRESENT, I AM UNABLE TO TAKE ON ANY MORE CASES AS A REPRESENTATIVE AT THE LONDON TRIBUNALS. THIS IS FOR BOTH PERSONAL AND LEGAL REASONS. PLEASE DO NOT PM ME UNLESS YOU HAVE POSTED YOUR THREAD ON THE FORUM AND I WILL ATTEMPT TO GIVE ADVICE.

There are "known knowns" which we may never have wished to know. This applies to them. But in the field the idea that there are also "unknown unknowns" doesn't apply as they hide in the aleatoric lottery. I know this is true and need to be prepared knowing the "unknown unknowns" may well apply.
