Impounded car due to new signage
« on: »
I’m in a frustrating situation and could use some advice.
I’ve been parking my car in the same bay for about 4 months with no restrictions or signs at all. Then, just yesterday, the council installed new parking restriction signs. Today, they impounded my car and are charging me £360 to get it back.
The kicker? I’ve never received a single PCN or warning during those months of parking there lawfully.
So while the removal isn’t technically retroactive since the signs were up before they impounded the car, it feels really unfair to be hit with such a huge charge right after suddenly introducing restrictions—especially with no prior notice or PCNs issued.
I’m planning to formally challenge the charge and ask for my car back without paying.
Has anyone else dealt with something like this? Can councils enforce like this without issuing any PCNs beforehand? Do I have a good chance to win the challenge?
Thanks for any advice or shared experiences!

I'm guessing Newham?

I can tell you there's nothing you can do without paying to get your car out of the pound.

When you do post all the materials.

Interesting. The law provides a right to make formal reps after being advised of this right subsequent to paying to release the car. However, as a 'windscreen' PCN was issued you should be able to make informal reps....and for every day that passes, sometimes months, your car would attract storage charges which would dwarf the penalty within a week.

I'm with stamfordman: recover your car and stay within established procedure.

Yes, indeed. Follow Stanfordman's instruction and get your car back. To assist you with what we must see as a minimum, please read this : -

If there is any good news at all, by retreiving the car from the pound for the requested amount, you have already paid all there is to pay and can appeal the matter all the way to the adjudicators at London Tribunals without any extra payment or risking any more money. If you win, you get all the money back.

A GSV view in the form of a link to where the car was parked is always useful too.

Please keep the pound paperwork exactly as they give it to you. Do not fold it or remove the staples.
I help you pro bono (for free). I now ask that a £40 donation is made to the North London Hospice before I take over your case. I have an 85% success rate across 2,000 PCNs but some PCNs can't be beaten and I will tell you if your case looks hopeless before asking you to donate.

Did you park before or after the new signs were in place?

Not really,  it doesn’t say the op parked after the new signs were erected.  They’ve been parking there for 4 months but is  at their work and’ they park daily or is it near their house and they only use their car a couple of times a week?
