Author Topic: Barney PCN 53J - entering in pedestrian zone - Essex Park North Of Wentworth Avenue  (Read 1590 times)

Hello everyone,

I recently received a PCN from Barnet Council for entering a pedestrian zone (code 53J). I believe I have grounds to appeal and would appreciate any advice you can offer.

When turning right from Essex Park Road to Wentworth Avenue, the signage indicating the pedestrian zone is nearly invisible. Additionally, trying to read the sign clearly would require me to slow down significantly or stop, which could pose a danger to the traffic behind me.

Has anyone successfully appealed a similar PCN on these grounds? Any tips or insights would be greatly appreciated.

Many thanks!

I do apologise. The link now should work.

In cases like this, the recommendation is that a warning sign be placed on the approach road where one turns right into the restriction. Is there such a sign there ? If there isn't your case is quite strong.
GSV is too out-of-date to show this restriction, so more legwork I'm afraid.

I think there is a sign, but it's pretty small (not regular size) and with the trees and parked cars on both sides of the road, it's pretty hard to notice it in time. I was wondering if the restriction sign should be on both sides of the road as they have in most other places?

In the same school area, there are signs on Moss Hall Grove on both sides, so you can easily avoid it and turn right into Thyra Grove (which I did a few days ago).

Sorry, but we really need to see what is there, (photo), if anything, to make a judgment on what you should do.

Hello

Here are some updates.

1. Entering Essex Park from Ballards lane. No signs for restriction.

2. Warning sign. Located just after two driveways, which is hotspot for delivery drivers to pull over. Having in mind that and the size of the sign it can be easily blocked from full-size van

3. Double signed in the same school area. Moss Grove Hall

Has anyone else experienced this issue or know if the signage should be more prominent? What do you think about my case? Any advice would be appreciated.

Unfortunately got another PCN from the same location

Can anyone give me advice for a ground appeal ? Thank you

@mtko I don't think the photos are very helpful and we need something better to illustrate the visibility of the signage.

Do you have a dashcam, a go-pro, or can you get a friend to sit in the passenger seat? It would be useful if you could drive the same route outside of the restricted hours to show the view from the driver's perspective.
I practice law in the Traffic Penalty Tribunal, London Tribunals, the First-tier tribunal for Scotland, and the Traffic Penalty Tribunal for Northern Ireland, but I am not a solicitor or a barrister. Notwithstanding this, I voluntarily apply the cab rank rule. I am a member of the Society of Professional McKenzie Friends, my membership number is FM193 and I abide by the SPMF service standards.

Hello

@cp8759 Thank you for your reply
I can record a video with a friend's help on Saturday, but when I was in the area today I noticed they covered all the signs around that school area already. Will that still be useful for recording video?
Many thanks

@mtko I think it would still be useful.

I have now got a copy of The Barnet (Prescribed Route) (No.2) (Experimental) Traffic Order 2024.

Hello again
@cp8759 Do you think I have any grounds to appeal here?

Hi mate, did you had any luck with this PCN. Even I have received the PCN for the exact same spot, exactly the same direction as yours.

Please to have a read of
https://www.ftla.uk/civil-penalty-charge-notices-(councils-tfl-and-so-on)/read-this-first-before-posting-your-case!-this-section-is-for-council-tfl-dartme/

and start your own thread (forum rule is one case per thread), and post there

a brief account of the circumstances,
all sides of the PCN, redacting only yr name & address),
the video (this is the evidence) and any council photos,
and a GSV link to the location.

By all means reference this thread with a link in your own thread.
