Hi

I'd like some advice on what I can do about my issue with this charge certificate, asking me to pay £240 from Ealing Council. I'll write the events as follows below:

- PCN no: AO05530640 Car reg: HF08 AEN
- PCN to owner received through post. Contravention date: 08/06/2025. Date of Notice: 12/06/2025
- PCN challenged on 25/06/2025 formal representation made through Ealing council online portal.
- Date of Charge Certificate on letter: 27/10/2025

I challenged on the basis that Ealing council's evidence was insufficient. Both images showed the same time stamp and the video footage did not work. What I don't understand is that I have not received a Notice of Rejection to my appeal through the post and that it has been well over 56 days.

Please could I get some advice and do let me know if any more information is needed.

We do seem to be seeing a lot of reps/rejections going astray, with OPs then getting a CC before a response is received. Have you looked on their website to see what is recorded against your PCN ? One can normally obtain an audit trail of some sort, which should include date of your reps and their reply. You could also phone them to find out what's going on.
How were your reps submitted, email, website, or post ?

Yes the status on my PCN is Charge Certificate and the sum of £240, which I have looked online on Ealing Council's PCN portal. I have an email acknowledging my initial appeal to cancel the PCN from 25/06/2025. I've tried to phone their PCN number and it is all automated.

I have edited my subject field and also added the PCN number, along with the car registration.

Normally shouldn't the council cancel the PCN if they haven't responded within 56 days.

Unfortunately not, because the 56 day limit only applies to formal reps against a PCN served under the Traffic Management Act 2004. You haven't shown us the PCN, but I expect it has London Local Authorities and Transport for London Act 2003 at the top.

If you can see the audit trail for your PCN on their website, it should show your reps and their response. If you can't get any sense of out them, then wait for them to send the Order for Reecovery, at which point you can submit a Statutory Declaration that you made reps but got no rejection. The process will then be reverted back to the reps stage.

Thank you for getting back to me again and pointing out that the 56 day rule only applies to the Traffic Management Act 2004 , really appreciate the help.

I'm not sure how to look at the audit trial on the Ealing PCN website, but I did make representation on their website on time and have an acknowledgement email for the appeal. 


IK, so your next state is the Order for Recovery, sent to you when the council register the debt at the Traffic Enforcment Centre. This is like a court, but has no courtrooms or judges, and there is not possibility at all, of getting a CCJ.
At this stage, you can submit a Statutory Declaration that you submitted representations, but did not receive a letter of rejection.

I'm a bit concerned that I haven't received anything in the post and the last paragraph is what i'm worried about from the Charge Certificate letter. Which states I have 14 days to pay and if not payed they will "recover the amount due as if it were payable under a county court order."

Do I need to do anything or do I still just wait for the Order of Recovery. The PCN on Ealing council portal still is showing the amount of £240.

That is the Order for Recovery stage, when on receipt of it, you can submit your Statutory Declaration. It's a routine matter, nothing to worry about. Councils love to intimidate PCN recipients by mentioning county courts. County courts are NEVER involved in the process.

you cnnot file the stat dec until the charge cert if filed with the fixed penalty branch or the court

What was said earlier re the courts is not fully accurate but you cannot get a CCJ for a civil motoring matter enforced by the council

I've received a Charge Certificate on the 27/10/2025. So i'm getting confused on when I should submit the stat dec.

Is it now or am I supposed to wait for another letter to come through the post. How do I know when the charge cert is filed with the fixed penalty branch or the court
