Received Charge Certificate - Newham Council

Hello everyone,

I’m looking for some advice regarding a recent issue with a PCN. Today, I received a Charge Certificate. The original PCN (contravention date: 07/09/2025) only arrived on 14/10/2025. As soon as I received it, I contacted Newham Council through their online portal to explain that the PCN had arrived after the 14-day period. I also stated that I was willing to pay the penalty provided I was given the opportunity to pay it at the discounted rate as its unfair that i have not given the time to pay the penalty in time.

However, instead of responding to my online representation, the council has now issued a Charge Certificate for £240, doubling the original amount. The contravention was for 52M – Failing to comply with a prohibition on certain types of vehicle (Browning Road, E12).

I would be grateful for any advice on what steps I should take next. I am concerned as I now have only 12 days left, and I genuinely did not receive the PCN within 14 days. I also cannot afford the increased amount.

There is a proper legal process that covers your situation, but until we see the Charge Certificate, we can't tell you the details of what  is needed. However, in summary, the process is that you ignore the Charge Certificate,  (i.e don't pay it !!). Then, when the period for its payment has expired, you must start to become proactive, and contact the Traffic Enforcement Centre about every 7-10 days to ask whether the PCN has been registered. Councils cannot seek to collect a debt until t hey have registered the pcn at this centre (TEC). When they do, they must send you a document called Order for Recovery. This adds the TEC registration fee, (£10) to the CC amount, and also means you can now submit a declaration to TEC that you didn't receive the PCN. TEC will then cancel the CC and OfR and the matter reverts to the PCN stage. At this point you can pay the discount or submit representations.

No doubt the Charge Certificate has intimidatory text saying if you don't pay, they'll apply to the County Court, blah blah. This is total tosh. They can only register the debt at TEC which is a court with no court rooms and no judges.There is NO POSSIBILITY of a CCJ.

The CC text is not too bad as it mentions the Traffic Enforcement Centre correctly if the CC isn't paid, yet oddly doesn't add in the TEC fee of £10. The CC says you have 14 days from date of service to pay, so as the notice date is 9th Dec,  service is assumed 2 days late or the 11th Dec. Adding 14 days to that gives 25th Christmas Day !! So after the CHristmas period is over, you can start phoning TEC to see if the PCN has been registered.
