Hi

This is my first time posting and wish to ask for advice about this PCN.

Contravention Date: 08/05/2026,10:15
Contravention: 01 - Parked in a restricted street during prescribed hours

The car was outside of a bay on a single yellow line- Bay hours are 10am - 5pm

Thursday 30th April 2026 - My car had broken down and was picked up by a mechanic.
Thursday 7th May 2026 -  A week later after diagnosis the mechanic said the car had engine failure, I asked the mechanic to return the car as i still had some belongings in and did not expect this result.

The car was returned and left on a single yellow line across from my residence, as getting it into the drive while the engine was not working was not possible. The car could not turn on to turn on the handbrake, so we had to use bricks to stop it from rolling.

I Booked in a company to collect the car and scrap, they were booked in for Monday the 11th, but had to cancel and did not pick up the car until Wednesday the 13th.

Friday 8th May 2026 - I received a ticket

I then appealed the ticket on the grounds of being broken down. I added footage of the car being dropped off by the tow van.

I was asked for further information proof of callout or breakdown. I did not have RAC cover on the day so i used a private company. I sent over the invoice that i received (it was just a simple pdf).

I then received another ticket on the 13th, which i also appealed, and  it says it has a 0 balance to pay, so believe that was cancelled.

I then received a reply to the evidence, saying it wasnt enough and that I would have to wait for an NTO. Date of the Notice is Monday 6th July 2026.

Please Help me with what i was missing in my appeal, and how i can possibly get this ticket removed.

This looks to fall into circumstances beyond your control except they could say you should have asked the mechanic to scrap it.

Acting under your instructions 'The car was returned and left on a single yellow line across from my residence' by your agent. It was inoperative before being parked.

What were the SYL's times on 7th and 8th?

The SYL times are

10am - 5pm Mon to Fri

the car came back on the 7th at 7pm

This looks to fall into circumstances beyond your control except they could say you should have asked the mechanic to scrap it.

My only defense to this was that I still had belongings in the car as I did not expect it to have been finished, and was hoping it would be gone on the 8th

I arranged for my car to be left opposite my house during unrestricted hours on 7th May. It was fully my intention to have it removed before the restriction became operative at 10am on 8th. Unfortunately the arrangements I had prospectively made did not happen hence why the CEO saw the vehicle in contravention at 10.15.

Would have been my framework. Whether you're beyond this approach really depends on how many cats you have already let out of the bag with your initial reps.

yes, ok, I mean that was actually my intention (nobody wants a car left outside over the weekend)

You are making written formal representations at this stage, there's no 'attending'.

The issue is not why the vehicle was dropped where and when it was because at that time it was an unrestricted length of road. IMO, the issue is why it wasn't moved prior to restrictions coming into effect at 10am on 8th. Reasons fall into distinct camps: statutory defences; other compelling reasons(why the PCN should be cancelled); mitigation.

Did you think you could move the car, if so how e.g. under its own steam, being towed etc? Were these realistic expectations, what went wrong etc?

NTO issued 6 July therefore reps to be submitted no later than 4 Aug. Plenty of time to discuss your approach.

The car could not be moved by itself.
We had been speaking to the scrap company since the Monday before, we confirmed as soon as the car was dropped, They replied the following morning that would see if they could fit us in, in the end they could not and then said they would pick up on the following Monday.
