Claim Form Received from Euro Car Parks on behalf of DCB through Civil National Business Centre

Quick update: I had my mediation call and went through everything line by line, just as you laid out. They didn’t want to settle at £0 or discontinue the case, and instead made me a counteroffer, which I rejected. So, it will now proceed to court. The mediator said he will arrange for the case to be transferred to my local court. So i guess i should receive that letter the one you mentioned about.

Try and call St Helens County Court and find out what is happening.

Just a quick update - received the letter to confirm it's been transferred to my local court few weeks back and now I have received a letter (Notice of allocation to the small claims track (hearing)).  The claim with be heard at the "court" at a certain date unless It states "the claimant has until a date to pay the court a trial fee", if they don't pay does this mean it won't go ahead and it should be dropped?

Yes, but please show us this letter so that we are abreast of what is happening with the case.

They will discontinue just before the trial fee has to be paid. Just wait for the N279 Notice of Discontinuance.

I received Claimant's N180 from DCB Legal but no court notice yet – Should I file now?

I am currently defending a small claim and reached the Directions Questionnaire stage. 10 days ago, DCB Legal (bulklitigation@dcblegal.co.uk) emailed me a copy of their completed Form N180.

To date, I have not received any correspondence or notification from the court, nor is there any update reflected on the Money Claim Online (MCOL) portal.

To avoid missing any procedural deadlines, should I proactively submit my own Form N180 via email to dq.cnbc@justice.gov.uk (CC’ing info@dcblegal.co.uk and myself), or should I wait for official notification from the court?

Additionally, does the court usually send this notice by post or email?

It's just bog standard boilerplate stuff. You will receive a letter from DCB Legal confirming that their client has received a copy of your defence and their client intends to proceed. They will include a copy of their N180 Directions Questionnaire which you just file away.

Eventually you will receive your own N180 DQ and you will follow the instructions below on filling it in and who and how to send it. Eventually you will receive a letter telling you about your telephone mediation appointment which is just a formality and is nit part of the judicial process. You will simply offer £0 and it will be over in minutes.

Here are the answers to some of the less obvious questions:

• The name of the court is "Civil National Business Centre".

• To be completed by "Your full name" and you are the "Defendant".

• C1: "YES"

• D1: "NO". Reason: "I wish to question the Claimant about their evidence at a hearing in person and to expose omissions and any misleading or incorrect evidence or assertions.
Given the Claimant is a firm who complete cut & paste parking case paperwork for a living, having this case heard solely on papers would appear to put the Claimant at an unfair advantage, especially as they would no doubt prefer the Defendant not to have the opportunity to expose the issues in the Claimants template submissions or speak as the only true witness to events in question.."

• F3: "1".

• Sign the form by simply typing your full name for the signature.

When you have completed the form, attach it to a single email addressed to both dq.cnbc@justice.gov.uk and info@dcblegal.co.uk and CC in yourself. Make sure that the claim number is in the subject field of the email.

Your N180 will be sent by post but if you monitor MCOL you will see when that happens and you can submit online. If you have any doubts you should contact the court yourself to check that nothing has gone wrong, it will be easier to fix now than later.
