Nexusgroup gate malfunction gym group greenford

My local gym has 2 hours free parking with 20 minutes grace period. Lately the gate does not open on exit after entering code. This is a reoccurring issue and the driver has to leave and go up to the gym to get workers to assist. Is this valid grounds to appeal?

That notice was issued on 26 June, 20 days after the parking event.

That notice is a reminder, we need to see the original.

Depending on its issue date, the following may apply:

As long as the driver is not identified, the registered keeper should appeal that they’re not liable because GroupNexus has not complied with the requirements of the Protection of Freedoms Act 2012 to transfer the liability from the unknown driver to the registered keeper, specifically

(4)The notice must be given by—

(a)handing it to the keeper, or leaving it at a current address for service for the keeper, within the relevant period; or

(b)sending it by post to a current address for service for the keeper so that it is delivered to that address within the relevant period.

(5)The relevant period for the purposes of sub-paragraph (4) is the period of 14 days beginning with the day after that on which the specified period of parking ended.
