Parking charge notice euro car park

Driver and passsenger went to Bromley. Parked at sainsburys. Ran an errand first. Then went to sainsburys to buy stuff. Left within 1 hour. Was always planning on buying things from sainsbury after running errand.

Receives notice. Didn’t realise it was a validate purchase affair. Have lodged an appeal to euro car park with a screen shot from bank app and nectar showing they were there making a purchase.

What are the  options ?
Do they need to email the branch.

What happened:

The driver and a passenger visited Sainsbury’s, Bromley, and parked in the car park. On arrival, the driver first went to run an errand elsewhere before entering the store. The driver then went into Sainsbury’s and made a purchase, having always intended to shop there after the errand. The driver left the car park within an hour of arrival.

The driver was not aware at the time that the car park operated on a “spend to validate” basis rather than a standard pay-and-display or ANPR-timed system.

Action taken so far: An appeal has been lodged with Euro Car Parks, including a bank app screenshot and Nectar receipt showing the purchase was made at Sainsbury’s during the stay.

Please act on the previous reply by reading the linked "Read this first" thread and providing the required information.

here's my appeal to ECP:
I am writing to appeal this Parking Charge Notice issued at Sainsbury's, Bromley, on 04/07/2026.

I arrived at 15:43. After parking, I was occupied dealing with my child and another matter before entering the store at around 16:15. I then shopped in Sainsbury's, spent £29.80, paid by card, and left shortly afterwards.

This was my first time using this car park and I was unaware that, despite shopping in store, I also needed to validate my stay at a kiosk.

I'm contacting Sainsbury's today....

I appreciate there was a gap between arrival and entering the store. However, I parked there to shop at Sainsbury's, and did so. I was not using the car park for any other purpose. I can provide evidence of my purchase if required.

I didn't look for signs/take any pictures and Bromley isn't local to me.

Don't submit that.

What if it's already been submitted?
Sainsbury's help desk are "no mate, have to go through ECP"

Please post the original NtK, as already requested twice.. Without this we can't help you because we don't know what you're being "accused" of doing.

Clearly your identification of the driver cuts off some avenues for an appeal, but we need to understand the whole story in order to give you the best advice we can.

I only have the Final Notification, not the original PCN/Notice to Keeper.

The notice says:

We understand that you were the registered keeper or you have been named by the registered keeper as the driver/hirer of the vehicle at the time the Parking Charge Notice (PCN) was issued by post.

The driver has failed to pay the notice amount within the time specified, as per the displayed terms and conditions on site.

OUTSTANDING BALANCE £85.00

The discounted amount no longer applies. Payment should be made within 28 days from the date of this letter.

You are notified under paragraph 8(2)(b) of Schedule 4 of the Protection of Freedoms Act 2012 that the creditor does not know both the name of the driver and a current address for service for the driver and invites the keeper:

(a) to pay the unpaid Parking Charge; or

(b) if the keeper was not the driver of the vehicle at the time of parking, to notify the creditor of the name of the driver and a current address for service for the driver and to pass this notice on to the driver.

If, after the period of 28 days beginning with the day after that on which this notice is given:

(i) the amount of the unpaid Parking Charge specified in this notice has not been paid in full; and

(ii) we have not been made aware of the name and current address for service of the driver,

under Schedule 4 of the Protection of Freedoms Act 2012, we do have the right, subject to the requirements of the Act, to recover from the keeper so much of that Parking Charge as remains unpaid.

Should you provide an incorrect address for service, we may pursue you for any Parking Charge amount that remains unpaid.

Should you identify someone who denies they were the driver, we may pursue you for any Parking Charge amount that remains unpaid.

Breach of Terms and Conditions: A voucher/receipt was not validated at the kiosk during the time period the vehicle was on site.

Update your car’s V5C if not already done. It won’t help here, but may avoid problems in future as well as being a legal requirement.

ECP don’t care if you paid £29.80 or £2,980 in the store, they operate the car park on the basis that they can pursue people who don’t follow the rules and they get to keep the money.

Are the signs clear or not?

You will probably next get letters from debt collectors, which you can ignore, and a Letter of Claim from a solicitor, which you should not. You will then be the object of a county court claim, to which you will have to submit a defence. You can’t use any “technicalities” on the driver not being identified, because you identified the driver in your appeal. Are you willing to stay the course - months - and do you have a valid defence to the claim that the driver entered into a contract by reading the signs and parking and is now being invoiced for payment under that contract?

Just to reiterate:
I've appealed to ECP already, pretty much on receipt of this final notification letter, and sent screen shots of my bank statement and my nectar purchase history showing I was in store.

Are the signs clear? Depends if you're looking for them, they don't appear to be/I don't remember seeing them.

I guess my only defence is: I was distracted on entry, I always entered the car park intending to be a customer, I was a customer, I was distracted on leaving so didn't validate.
