APCOA Parking Charge Manchester Airport

The driver dropped someone off at airport, they actually paid for the parking but they made a mistake in that they entered the wrong drop off time (see attached). Can you please advise best way to appeal this, should the registered keeper appeal and share the receipt or argue a contravention, if so please advise which one, thank you in advance.

The driver dropped someone off.

As Manchester Airport is subject to byelaws, it is subject to "statutory control", and as such, not relevant land for the purposes of Schedule 4 of the Protection of Freedoms Act, meaning they cannot hold the keeper liable. You could therefore appeal along the lines of the below:

Dear Sirs,

I have received your Parking Charge Notice (Ref: ______) for vehicle registration mark _______, in which you allege that the driver has incurred a parking charge. I am appealing as the registered keeper of the vehicle. There is no obligation for me to name the driver and I will not be doing so. I note from your correspondence that you are not seeking to hold me liable as the registered keeper, under Schedule 4 of the Protection of Freedoms Act 2012 ("The Act").

Even if you were seeking to do so, as the Manchester Airport Upper Drop Off Forecourt T2 is not "relevant land" as defined by The Act you are unable to recover the charge from me, the keeper.

I am therefore unable to help you further with this matter, and look forward to your confirmation that the charge has been cancelled. If you choose to decline this appeal, you must issue a POPLA code.

If appealing online, make sure there are no drop down boxes etc. that force/trick you into revealing who was driving - you are appealing as the keeper, and saying nothing about who was driving.

Anyone prepared to accept a bet for £25 that APCOA will respond with a letter that says: "the driver is a very naughty person and must not break APCOA's self imposed rules as it deprives them of sustenance. However, on this occasion, they will let you off and don't be so naughty in future."

As expected. However, they've now shortened their response.

I'm expecting two PCNs for picking up and dropping off at Manchester Airport last week. Whilst I don't condone everyone to do this, personally, I refuse to pay the rip-off charges.

Not APCOA ones, they've never done court. VCS are stubborn enough to - a search on here and MSE would yield some results.

Whilst VCS are likely to issue a claim if they succeed at POPLA, I am not aware of any that have actually gone all the way to a hearing in court.
