Winforton St/Blisett Street PCN

Hi All,

Need some help here. Had a Kidney transplant recently (8th April) whilst coming back from hospital appointment SatNav routed me through this route, any hope here? I am off work on sick leave and could have done without all this additonal stress!

Oh dear, yet another "satnav assisted PCN" !

We see so many of these nowadays where drivers seem to obey the instructions like automatons and ignore roadsigns. Looking at your case though, the signs do seem to be excessively high, and a recent (yesterday) case at London Tribunals on this very subject was won.  So there is hope.

Other thing to check on is the presence or absence of advance warning signs. Unfortunately GSV is out-of-date here so doesn't show the restriction signs, which means it won't also show any advance warning signs. So if you want to build a robust appeal case, you'd need to do some legwork to find out if there are any advance warning signs of the restriction.

There may be a 'technical' appeal based on Grenwich mismanagment of the enforcement process. Such appeals are not related to the allege contravention so can win even if the contravention is made out. So wait a bit to see what may be suggested, but don't miss the deadline to pay or appeal on the PCN.

There was this advance warning sign which I missed    -

Sorry to tell you, but that advance warning sign is of the type we like to see, as it is clear in indicating the nature of the restriction ahead. So the presence of this sign considerably reduces the strength of any representations you submit.

So far, nobody has suggested any 'technical' appeal, but submit representations anyway, because sometimes councils make serious errors of law when replying to reps

My appeal was refused. Planning to pay this off!

Not yet pl, providing you're within the discount period.

Pl post your reps and their rejection and leave in everything except the addressee's details e.g. we need the VRM and PCN number etc.

Plus, are you the registered keeper?

The restriction and optional advance warning signs are not the same i.e. one does not refer to the exceptions. Whether this is significant, I don't know.

Due to my recent surgery and compromised immune system, my energy levels were severely strained. I am unfamiliar with these new local restrictions; they were not on my navigation system.2. Procedural Impropriety: Under London traffic legislation, the 14-day discount period must begin from the Date of Service. This PCN states it begins with the "date of this notice". By calculating from printing rather than delivery, the council illegally shortens my statutory windows, rendering the PCN defective and void.Please cancel this notice.'

Thanks. You've left your name on the last page of the 'Appeals' form, but at least this gives us your VRM.

They have re-offered the reduced sum, but I can't work out by when it should be paid i.e. what is the '14-day period' in the context of the NOR.

As regards your reps, your first point goes to mitigation only. And as regards the second:

Firstly, there's no grounds of Procedural Impropriety under London moving traffic legislation and secondly both payment dates(full penalty and discount) are based on 'Date of Notice', not date of service. Paras. 4((iii) and (iv) refer:

IMO, neither of your grounds of representation flies.
