Hello everyone,

cp8759 advised me to post my topic here http://forums.pepipoo.com/index.php?showtopic=152282 on this forum also:

Got a PCN letter through the post which ruined my Saturday morning, and I think I've been wrongly charged.

PCN:

Video evidence:

(VRN close up)
Image evidence 3: https://flic.kr/p/2pjccGK
Street view: https://www.google.co.uk/maps/@51.5570244,-...i8192?entry=ttu

Its not that long ago so I remember that I actually stopped right before the yellow box, and the video evidence confirms this.
The evidence images blur out my car and only show the silver car in front, except for the one image which is a close up of my VRN.
So it seems the council mistake my car which is the grey Astra with the silver car ahead that went into the box.

How do I get them to cancel the PCN please? I challenged it via their online portal but haven't heard back for over a month!

Many thanks in advance for any advice you can give.

If you have already submitted representations, you must await a reply. Please post it here when you get it.
Is your car grey, it looks black in the video ?  Anyway, definitely no contravention whatsoever as the video shows. Looks like their camera operator needs to go to Specsavers. Quite disgraceful to issue such a load of tosh.

I don't even think the silver car committed a contravention.  It slows as it reaches the end of the box but can't see that it actually comes to a complete stop until the video ends.

Correct. I can't see the silver car stopping at all in the box. The general assumption is that one has to be stopped for more than 5-6 seconds for an offence to be committed and the CCTV does not show this. The fact that it is not even your car adds insult to injury. If you have not already appealed, send the CCTV back to the LA and ask  them to blow up the number plate (on your car) in that video and ask them if it shows you stopping in the YBJ.

There is no time limit which applies to a contravention and many adjudicators do not employ any de minimis arguments at  all.  The ones who used to have now left.

There are "known knowns" which we may never have wished to know. This applies to them. But in the field the idea that there are also "unknown unknowns" doesn't apply as they hide in the aleatoric lottery. I know this is true and need to be prepared knowing the "unknown unknowns" may well apply.

Sure, here is the letter: https://flic.kr/p/2psRap2

Thanks.  They can't even use the correct term:  Notice to Owner. Yet another templated letter.
