TFL PCN Stopped on redroute - lacking any real evidence.

Hi all,

Im in a bit of a pickle - essentially I was driving and wanted to pop out to a store outside of my area. I saw a space available on a genuine red route (but it had parking spaces) upon driving in I didn't even get out of the car (I looked out the window and it had signage of being a electrical parking bay on a red route (Stopped where prohibited (on a red route or clearway)). literally 20 seconds of sitting in the bay and not leaving my car I drove away as I was blocked by traffic. However on the photos the TFL manned camera has provided there is only a photo of me driving away on the bend on the red route. As you can see my brakes are engaged as my rear brake lights are red while im turning the bend. However actual proof of me sitting in the electric bay as per the photos of the manned camera there is no way at all they can prove that it was my car sitting in the bay for 10 seconds as it shows a similar car / make and model.

Any chance I can appeal this on either 1. limited timing per the PCN photos I parked in at 14:45.59 , and I was leaving to the main road at 14:46.43.
2. Limited proof it was actually my car / number plate sitting in the electric bay that broke the rules and stopped. the only proof they have is me with my foot on the brake turning the corner onto the main road.

Please ring TfL and get them to send you the video. It will come as a DVD. They then freeze enforcement for 2 weeks to allow the video to be produced, posted and received. You must be careful, though, and if the DVD hasn't arrived in about 10 days, contact them again, because the unfreezing occurs automatically, and you don't want to miss the deadline for subitting reps.

My view is that you have a good case, in that you stopped in the bay, read the sign, saw that it was for EVs, so drove off. This scenario has won appeals at London Tribunals.

OP, the video will show all.

GSV suggests the bay is a single car's length with a carriageway-facing sign which would be easily readable in a couple of seconds. So, if the video shows the car pulling in, stopping and then trying to pull away after no more than this period then you should be OK.

Okay, I will request - is the process usually to call to request the DVD? Or via the response / appeal process. Also can the send the DVD in any other format I.e email or something - seems really old age running a TFL video via CDs not sure I even have a CD player.

Also noted regarding the 10 days pause this is critical thanks for this.
