Ealing, alleged traffic contravention of 51J, failure to comply with a no entry restriction, Manor Road

Hello

Received a PCN from Ealing Council. I apparently entered a no entry restricted road. Funnily enough, I did do a U Turn and exit the road. I think, if I recall correctly, there were roadworks happening on Argyle Road near West Ealing station and they had completely blocked it off. I turned right onto Manor Road trying to work out if I could go around but realised I couldn't and did a U Turn and came out.

There were other vehicles dropping people off outside the station so didn't realise I wasn't supposed to enter. In fact, the first picture they show on the PCN is me leaving the road.

I have requested to review the evidence via viewmypcn.co.uk but haven't seen it yet at the time of writing. It doesn't seem to open on my PC or my mobile. Have tried different browsers etc as well...

Would be grateful for any advice on whether I could appeal this as it was done out of genuine ignorance...

GSV is unfortunately out-of-date as far as I can see. I suspect the building works were part of a rejig for the station that made it one-way only.

If you're local, some photos would be useful, one showing the approach for a RH turn and one for a LH turn, plus the entry to the street. We need to see what signs are in place.

Don't bother !  The video is now online, I suggest you look at it on the Ealing webpages. It shows you driving past two No Entry signs, albeit these are temporary, I think they are still legal signs.

So i think this is where the confusion lies. You see the car that I stopped for to let past? I had entered Manor Road from that side like them. Realised as I went down the road that there wont be a way around for me to get to my destination. Hence the U turn and me driving back out.

I didnt see those signs but admittedly they dont make sense because that's the only way in and out of Manor Road. If you follow Manor Road you'll end up near Drayton Manor High School which is far from my destination.

So not sure how they could block motorists from exiting the road unless there was a diversion route to follow which I dont recall seeing...

Whether the contextual road configuration is complex or not, a driver must comply with signs. In this case, the video shows a clear No Entry for Vehicular Traffic sign which was there to be seen. I suggest you concentrate on the sign and PCN. Others are more expert on the substantive issue, but in my mind the following questions arise:

1. Is there a traffic order provision which underpins the sign?

1.—(1) The sign must only be placed to indicate the effect of an Act, order, regulation, bylaw, resolution or notice which prohibits or restricts the use of the road by traffic.

2. If not and it is a Schedule 36 traffic sign then are the contravention grounds correct and does the distinction make any difference?
