Reasons
Mr has produced a copy of a charge certificate he was served on 30 December 2026.
The tribunal accepted his application to appeal on 15 December 2025. The authority would have been duly notified, and should not have issued a charge certificate.
Paragraph 5 of Schedule 1 to the London Local Authorities and Transport for London Act 2003 specifies the circumstances in which a charge certificate may be issued. In these particular circumstances, a charge certificate could only have been lawfully issued if no application to appeal against the notice of rejection was made within the 28 day time period.
I therefore find that there has been a failure to follow the procedural requirements of the 2002 Act in relation to the issuing of the charge certificate.
