Speeding fine paid followed by SJP

Hi - I've recently received my first 2 speeding fines in 20 years. Unfortunately it was on an A-road dual-carriageway, with a new average speed check camera I was unaware of it.
As a result I received 2 fines on the same day - 1 for each way.

I paid and completed a speed awareness course for the first and considered the matter closed. I then paid the fine for the 2nd and considered the matter closed.
Both of these was in May 2024. I accepted guilt in both cases and send back a S172 containing my driver licence details.

Yesterday (25/10) I received a SJP for one of the offences. In addition I've received 2 emails implying that I'm being refunded for the 2 FPN's already paid.

I'm a bit lost here as I do not understand why this happened and it is not being explained in the SJP.

I'd appreciate some guidance on how to progress with this in a way to minimise cost and penalty points. Also how can I find out what I did wrong here?

Presumably one FPN, since you got a course for one of the offences?

Did you only supply your driving licence details in response to the s 172 notice, or also in response to the FPN? You have to do both. If you didn’t, then you didn’t comply with the terms of the FPN, hence why you’re being prosecuted.

You can plead guilty, explain what happened and ask to be sentenced at the same level as the FPN. The court might agree but you might still end up with additional court costs and a victim surcharge.

Hi - to be honest, I cannot remember if I supplied it for both. However, I assume I did as I have received a copy of the completed (by me) S172 with my drivers licence details completed as part of the SJP.

Also, yes, 1 FPN as I did the course.

Unfortunately I suspect that the requirement to supply your licence details in order to comply with the COFP is not satisfied by you having previously submitted your details when replying to the s172 request.

Daft I know, but many people seem to fall foul of this requirement.

I don’t know why you assume you did. Completing the s 172 notice doesn’t mean you supplied your details in reply to the COFP. The fact you now have an SJPN suggests that you didn’t.

It usually says why in the statement from the tubby. Otherwise you would need to ask the central ticket office.

In terms of the SJP - can this be cancelled and the FPN charge reinstated?

What is the implication of this? Do I get a criminal record, like for any other "serious" crime?

No. What you can do is plead guilty (you are) and, in the Mitigation section, explain the circs (briefly) and ask the court to consider fining you at the FP level.

No criminal record, it's not a recordable offence.
