« on: »
Got caught by a mobile camera back in November on a dual carriageway 70mph doing 100mph stupid i know but i have been charged and now have to decide plead guilty not guilty etc i have no problems in pleading guilty as it was me, im 50 years old clean licence up until now part time care for elderly parent so no longer work full time wife has also retired due to health issues is there any point in hiring a solicitor on my behalf to deal with this or just fill in the plea and give mitigation as to try not to get a ban

What would be your mitigation?

Honestly no excuse but was on the way to a funeral i also lost my Mum earlier in the year i am self employed need to drive as a mobile mechanic and am the only person that brings any real form of income in, my elderly father also lives with me he does still drive but not that far anymore he is almost 82 so he also relies on me for getting him around alot

A ton isn't necessarily an 'instant ban'.

Indeed, the SJPN process will consider 6 points first before referring the matter to a hearing - you may get lucky.  (It is just a band B offence)

Any ban would be relatively short, a matter of a few weeks unless there are any aggravating factors.

Is it worth me going to court to do it in person or just say that i wish to have it dealt with and go to court if requested?

The guidelines suggest either a ban of up to 28 days or 4-6 points. The overwhelming likelihood is six points. The Single Justice will not disqualify you in your absence. In the unlikely even that  disqualification is considered, your case will be adjourned to a hearing in the normal Magistrates’ Court and you will be asked to attend.

You will also face a fine of  a week’s net income (reduced by a third for your guilty plea), a surcharge of 40% of that fine and around £95 prosecution costs.

Sentencing for speeding is quite prescriptive and there is rarely anything that can be said which will significantly influence the outcome. There is absolutely no point in engaging a solicitor.

In summary, plead guilty and do not ask for a  personal hearing which you can attend (unless you particularly fancy a day out).

Anything that suggests you were distracted and that you didn't have your mind on driving is best left unsaid.
