Single Justice Procedure - Speeding - Help!
« on: October 04, 2024, 01:53:37 pm »
I was caught speeding by a camera in West Yorkshire (41mph in a 30 zone at 06:35 in the morning) and accepted the points and paid the fine online last April'24.. the retaining house was not offered as ineligible.
I thought this was the end of it and forgotten about it until last week when I received a Single Justice Procedure notice stating that I had responded to a request under Section 172 of the Road Traffic Act 1988 and admitted I was the driver at time of offence and had paid the conditional offer, however, my licence details were not received by HMCTS.
- I just checked and I've received no other communication in the time between paying the fine and there was no data input boxes or areas or online form to do so when paying and accepting to put the licence information in to... if there was I would have done so!
Since getting this SJP last week the fine money I paid last April has now been returned to my bank.

The SJP asks for a plea of Guilty or Not Guilty - however, I've already accepted and paid a fine last April so they know I'm guilty!

I've no idea what's going on as it all seems totally illogical, is anybody able to help please?

You always have to supply the driving licence details when accepting a CoFP, so if you didn't, you must have missed the request to do so.

So once the "C" part of the FP was not adhered to, it has gone to court as expected. The fact that you attempted to accept the FP matters not a jot now, you can plead guilty or not guilty. However unless you have some defence not mentioned, pleading not guilty could be expensive. The best course of action would be to plead guilty but ask to be fined the FP level.

I assume "retaining house" was a typo for "retaining course"?

Thanks FuzzyDuck - yes it was a typo!

Sorry for my ignorance - but what is the all park cost of the Fixed Penalty fine?

How ironic. This will go quicker if you proof read your posts because the above makes no sense.

So once the "C" part of the FP was not adhered to, it has gone to court as expected.

The Conditional part of a COFP is that the driver is not liable to tot up. The rest are requirements to accept, not conditions.
I am responsible for the accuracy of the information I post, not your ability to comprehend it.
