This morning, 10th August 2024 I received a NIP from Hertfordshire Constabulary for my vehicle allegedly traveling at 80mph in a 70mph motorway limit on the M25 at Junction 21A-22 at 10:37:56 on 3rd August 2024. Supplied with the NIP was an Offence Viewer Log On Help Sheet, providing access to evidence including a speed camera configuration report and photographic evidence of the alleged speeding offence.

However, I remember this journey well as I was headed to pick up my family from the airport and was ahead of schedule so was not speeding at all on this journey and did not go above 70mph as it would have got me there too early. Unfortunately my dashcam doesn't record speed, but I understand it wouldn't be sufficient as admissible evidence against the speed camera anyway.

Nevertheless, I have read this: http://www.pepipoo.com/Inaccurate_speed_cameras.htm and wonder if loud music in my or the adjacent vehicle or the adjacent vehicle itself could have impacted the reading? Obviously I cannot measure the exact distance traveled in the alleged 0.35 seconds the photos were taken apart on the M25 to get an exact distance covered in that time, but if I was traveling at below 70mph, what can I do to demonstrate it?

You would need expert evidence. That will cost you a pretty penny, which you may get back if you win. However, the prosecution may also deploy their own expert, and you would pay their costs if you lose (several thousands of pounds).

How sure are you that you didn’t creep up to 80?

100% certain I didn't creep up to 80. 99% certain I didn't go above 70.

Unless you have done one in the past 3 years, you will be offered a driving course. Up to you whether to risk thousands in court.

The car in lane 3 is clearly going faster than the car in lane 2 - so if you were the car in lane 3, it seems unlikely that a higher speed was recorded by incorrectly measuring the speed of the wrong car.

If you zoom in to the photos, you should be able to count how many dragons teeth you passed. You should eb able to get a reasonable estimate of the spacings from Google Street View in satellite mode, and you know the timings between the 2 images.

You should be able to determine whether you were doing about 80 or about 70 from the above.

The Pepipoo article regarding loud music is comedy gold. So unless you had a metal plate connected to to a speaker in an open boot, I wouldn’t try that defence in court.

And don't forget that whatever issues you have with the speeding offence, you must respond to the request for driver's details in the time allowed. Failure to do so will see you commit a more serious offence which carries a hefty fine, six points and insurance grief for up to five years.

I guess they would never let the cash cow of speed cameras dry up simply because they were found not to be inaccurate and no amount of legal experts proving this help matters. I guess I'll just have to bend over and take it!  :-\

Salient question you left unanswered, which lane is your car in, 2 or 3?
The car in lane 3 is clearly going faster than the one in lane 2 which would lend some credibility (not proof) that the car in lane 3 is speeding.

Speed cameras are just about self funding, so hardly a cash cow,
There are motorists who have been scammed and those who are yet to be scammed!
