Notice of Intended Prosecution - A1, dual carriageway, 79mph

Hi All,

I've just received a NIP this morning. Alleged offence is speeding, 79 mph recorded by automatic camera device on a dual carriageway (speed limit 70 mph). It seems to be an average speed check on a 3.2-mile stretch of the A1 in Lincolnshire. The irony is that I'd just finished my first Speed Awareness Course this morning when I found the letter in my post!

I've emailed the police force asking for any photos that would help me to identify the driver as other people use the car. Let's see what they come back with.

I also tried to check the camera calibration certificates, but they appear to be missing from their webpage (https://www.lincs.police.uk/advice/advice-and-information/road/l/camera-information/). None are listed for the A1 and cameras S005 and S006 are missing. Looking at the maps of cameras in Lincolnshire (https://www.google.com/maps/d/u/0/viewer?mid=1oEHbCaCOT07Fkh35R-ESIyU2FJRle-w&ll=52.81139833371472%2C-0.44694131710394824&z=12), it seems that S005 may have been the camera used. The location on the NIP is listed as "A1 - Colsterworth to, Great Ponton", which seems to match S005.

I've emailed the police force to ask for the calibration certificates for S005 or whichever camera was used. Do they have to provide me / the driver with these? If they don't provide me with any, when their policy appears to be to provide them to the public via that webpage, could that work in favour of the driver in some way?

Lastly, the photos they've provided don't have any times, speeds, locations etc, which seems strange to me:





Is the lack of information on the photos something that could use to the driver's benefit? Any guidance would be greatly appreciated. Thank you!

Quick update:

The police force responded very quickly to my queries. They have provided a camera calibration certificate which appears to be in order / valid. They have said they have no further images to help identify the driver.

So my questions are, does the lack of information on the photographic evidence they've provided mean anything legally (times, speeds, locations etc)? Or the lack of further images? Thank you!

You don't know what information or images they have as they are not obliged to share anything with you at this stage. You already have more than you are entitled to,

It would be surprising if they could not prove their case in court. Average speed systems are very simple and extremely accurate. They simply take a photograph of the vehicle at the beginning and end of the stretch and measure the time elapsed between the two. Since the distance is known, the speed can be calculated.

The way to find out what they have is to decline the fixed penalty which will almost certainly be offered and have the matter heard in court. Then you will be provided with the evidence they intend to rely on to convict you.
