NIP responded to but did not receive FPN. Now received SJPN

June 24 S172 offence for speeding 79mph on motorway, first offence. Received NIP and completed/returned. Provided driver details. Did not receive offer for workshop/FPN in post. Did not receive reminder either (allegedly sent in July according to police witness statement). December 2024, received SJPN. Want to make police/court aware that had July post been received, would have accepted workshop (to avoid fine, points and increased insurance premium) and would not be in this position. Police advised writing letter as well as completing SJPN. Appreciate need to respond within 21 days in any event but unsure how to proceed/complete SJPN (i.e. guilty/not guilty) and whether to send letter requesting drop charges. Any advice appreciated.

Assuming the limit was 70mph you should have been offered a course for that speed (if you have not done one in the previous three years). However, the court has no power to order a course so that option is now off the table. But even if the limit was reduced to 60mph, you should have expected a fixed penalty to be offered.

You should respond to the SJPN by pleading guilty. In the “mitigation” section you should say that although your speed was within the range where a fixed penalty would normally be offered, no such offer was received. Go on to respectfully ask the court to consider sentencing you at the equivalent to the fixed penalty. They have guidance which suggests they might consider this in your circumstances.

Whilst the OP's OP (and so far only post) is far removed from an advert for the Clear English Campaign, some appear to have struggled to read the third and fourth "words" before posting their considered advice.

Thanks all, sorry for the conciseness of original post. To clarify, the police allege they sent a letter and reminder letter with options to attend speed awareness course or fixed penalty fine but these were never received. Had they been received, would not be in this position and making plea to the court.
The offence is for driving on motorway at 79mph contrary to S 17(4) RTRA 1984 and sch 2 RTOA 1988. Thanks

Hi, no not a lie at all, just confusion my end. Offence is speeding (79 in 70) only. Complied with providing driver details under S172. Please be kind to people on here, they’re asking for help… No need to jump to conclusions.

Please show respect for those that you hope will give up their free time, by providing clear and accurate information - and in particular not lying to them.

The first 4 "words" of your first post are "June 24 S172 offence", and you are now telling us that the only charge is speeding. Please explain how this is not a lie, and why you those that you have lied to are required to "be kind".
