NIP recieved 62 in a 50

Posting on behalf of my girlfriend...

She has received a NIP for doing 62 in a 50.  She has previously done a speed awareness course approximately xx years ago.

The car is leased so obviously it went to the lease company first and has therefore taken longer than 14 days to get issued to her.  However, date of the offence is 26/06/2025 and the dare of the NIP is 16/10/2025.  4 months seems very long for that process to happen, is this normal / acceptable?

I guess the answer is to just complete the S172 and take the medicine of 3 points and a fine.  But wanted to check in with you guys first.

It is a longer delay than most, but of no relevance to the process. It may well have gone to a finance company first, adding another step in the chain. Worth checking that the lease company has her full/correct/up to date address for any further incidents.

Depending on the meaning of "xx" she may have qualified for another course, but the delay in receiving the notification probably rules that out.


I guess the answer is to just complete the S172 and take the medicine of 3 points and a fine.

Far from being abnormal or unacceptable, there is  no requirement to send a NIP to her at all. The only requirement is to send one to the Registered Keeper.

With an offence date of 26th June, she may now be too late to be offered either a course or a fixed penalty. Most police forces have a cut off of four months as they must begin any prosecution within six months. Responses after that cut off will see them begin a prosecution.

All she can do is respond to the s172 pronto and hope for the best

Ah sorry, I had written it and was waiting for her to come back to me on when she did her course.  It was October 2023 so I guess that means she won't be offered a case this time round?

We'll get the S172 completed and she can take her medicine!

If this happens, i.e. the next thing you get is a SJP, then it is worth asking that she is sentenced at the Fixed Penalty rate (rather than the usual multiple of earnings plus all the extras). The magistrates' guidelines say this should be case when the delay is purely administrative and out of the control of the Defendant.

The offence will time out on 26/12/25 so you may want to leave it to the last minute to send it back. You're a little short, but depending on the date of the COFP, if they issue one, then you may or may not be in the clear.

Okay so correct me if I am misunderstanding but this is the predicament.

The police have 6 months from the date of the offence to start proceedings, otherwise it will time out.  However, to combat that, most police forces will start from 4 months and if the ducks aren't in line, just go straight to SJP in the interest of not letting it time out.

So we can either respond the S172 asap to try and ensure we get in there before the police go straight to SJP.  Or we can slowball it, complete it on day 28 from the NIP we have received and hope they aren't on top of everything and ultimately it times out.

I guess it would come down to whether or not you feel lucky...  Well do you punk?

Correct, both the understanding, and unusually, the film quote.

Proceedings are generally instigated a few days before the 6 month time out, but the "decision" as to whether or not to issue a COFP or not is often taken nearer to the 4 month mark.
