NIP Received for Speeding

Would someone be able to check if this NIP is in order and if i have any defence against it ?

Also i don't think we were doing that speed is there any way of challenging this ?

You can't defend a NIP, it's simply a notice.

So must identify the driver, unless you want to commit a much more serious offence and then see what the authorities offer. At that speed a course should be offered (unless you have done one in the last 3 years), otherwise you will get a conditional offer of a fixed penalty, i.e. 3 points and £100.

You of course can ignore the offers and take it to court, but unless you have a defence better than "I don't think I was going that fast", that could prove expensive.

The NIP was served on you within 14 days of the alleged offence (as it must be). Is there anything contained in it (apart from the alleged speed) with which  you don't agree?

You cannot challenge a NIP - it simply informs you that a prosecution is being considered. But you can challenge the allegation. The Magistrates' Court is the place to do that, where the driver will finish up if he declines any out of court disposals that my be offered.

There is no "we" involved here. Only one person could have been driving at the relevant time. If you are the recipient of the NIP and you are the person keeping the vehicle, you must respond to the accompanying "request for driver's details" by naming that person. This is regardless of any issues the driver may have with the allegation itself.

The speed was almost certainly measured by an approved device. What makes you think it is incorrect?

If the driver accepts the allegation as it stands he should be offered a course for that speed.

Could be an expensive day out without proof of a misread.

If you are basing this on the fact you saw the van and slowed down, bear in mind they can clock you up to 999m away when you may well have been unaware to their presence.
