NIP received 28 days after offence
« on: »
Hello, i have received a NIP
The offence was 06/12/2024 and the NIP letter is dated 03/01/2025.
Looking online it says i should have received the letter with in 14 days.
I need advice on what to do next
Thank you

Yes, the advice you found online is absolutely correct. So correct in fact that I am surprised that you need to seek further advice.

If you read section 1 of the Road Traffic Offenders Act 1988, it clearly states that Jordan1992 shall not be convicted of any motoring offence unless he receives a NIP within 14 days from the date of the offence.
I am responsible for the accuracy of the information I post, not your ability to comprehend it.

We need a lot more information.

Are you the registered keeper of the car? If so what is the doc date on the V5c?

It's only the first NIP in the chain that has to be delivered within 14 days.

Thank you for your replies.
Yes the vehicle v5 is in my name.

Do i need to respond to the NIP confirming i was the driver at the time of offence?
And then once i receive the next letter appeal then?
Im not sure how i appeal

Thank you

Yes the vehicle v5 is in my name.
Have you checked that the address on the V5 is 100% correct? (check, don't assume that it's right).

This is where im not 100% sure
I’ve recently moved and sent my v5 off around the same time as the offence to change my address.
How can i find out if this is the first NIP sent by the police?

...
Yes you need to do so even if the NIP was served out of time.

As you notified the DVLA by post of a change of address 'around the time of the offence' it is 99% probable that they had your old address on record when enquiries were made.

What is the date on the NIP? Do you have mail forwarding in place from your old address to your new?

MickR's question is worth answering. Do you have your new V5C yet and if so, what is the doc ref date on page 2? That should tell you when the address change was processed in relation to the offence date.

Thank you all
I spoke with the relevant police force today.
The 1st NIP was served with in 14 days to my previous address, they then searched via insurance for the NIP i received.
All meaning there is no escaping these points and fine.
Thank you for your replies and advice
