NIP received 2 months late
« on: November 26, 2024, 08:36:28 pm »
Hello, I've ready the sticky and am seeking advice before I take action.

I showed up at my fathers house last night (haven't lived here for over a year) to look after his elderly dogs to find a plain white envelope addressed to myself on the kitchen table.

Inside is a NIP Reminder of application for the identity of the driver for a speeding offence dated 11-Nov-2024.

Attached to this is the original Intention To Prosecute dated 31/10/2024.

The details all seem correct, I believe this was me and the offence of driving 36mph in a 30mph zone seems reasonable too as I was unfamiliar with the area.

I'm already well outside of every and all response windows that are articulated in these documents. Had there been an "urgent - immediate attention" note on the front my parents may have told me about it, but they didn't.  And there is no sign of the original NIP.

Some background information - if it helps:
Because my income is so low I've been moving between places, often spending a month or two homeless in order to take the edge off the surging rent prices.  As a result I have spent much of the last few years not knowing where and when I'll live next, so I elected to keep my drivers licence attached to my fathers house along with my bank account until I find somewhere to settle.  Having found somewhere I will settle for the next 6 months I have now updated my drivers licence address. I wonder if this was a foolish impulse to follow as I have, in violation of the advice of the sticky, done something.

I want to say what's happened, as it has happened, pay a reasonable fine or complete a speed awareness course, but as I read it this is now a matter that will only be dealt with by way of summons to a Magistrates' Court with the potential of a £1000 fine and 6 penalty points.

If I had been ignoring an original letter I'd feel like I deserve this but the envelope is so anonymous and letter past the time I'm scratching my head on where to go from here.

You can only try to make a driver nomination, it may still be accepted. You are not yet quite at 28 days if the original notice was 30/10. If not you may be dual charged with failure to furnish and speeding - in this case there is a well known plea bargain of offering to plead guilty to the speeding if they drop the failure to furnish charge. You can also ask to be sentenced at the fixed penalty rate, this may be successful if you explain the circumstances.

Note that it is the vehicle that gives the address for tickets to be sent to, so you need to update the V5.

It seems unusual for them to issue a reminder 11 days after issuing the original NIP.
In the subject heading, you state that the NIP (which you haven't received - but that's just being picky) was received 2 months late.
The other information provided suggests that this is bollox.

Perhaps you could clarify before any more time is wasted going down rabbit holes?

Apologies, I did miss a key date.  Free time being very sparse, made some oversights.

Offence: 20/09/2024
NIP: 31/10/2024
Reminder 11/11/2024

So I do actually have the rest of today to respond with the driver information.

On what basis are you asserting that the NIP dated 41 days after the speeding offence was the original NIP?
The timeline suggest that this was the "reminder" NIP

You have told us that you are outside of the timeframes articulated in the notice(s) received, and also that you still have time to respond. We don't provide reading lessons.
