Hoping for some advice and help regarding NIP dated 25/7/25.

cctv footage is attached.

The vehicle is a taxi which stopped for a fare paying passenger with a disability for approximately 10 minutes. There is a dropped kerb which allows vehicles to cross the pavement to go into a car park however the yellow barrier was down and there are no other places to stop. The passenger is a regular customer and maybe willing to assist.

Any help on NIP/appealing would be greatly appreciated.

You can't appeal a NIP, it's just a notice. All they are requiring at this stage is the name of the driver, which must be complied with (else a more serious offence is committed).

Once the driver is known the police will most likely offer a Conditional Offer of a Fixed Penalty (CoFP) or driver training course. At this point the driver can decide to take one of the offers, or ignore it and wait until a Single Justice Procedure Notice (SJPN) to be served.

The driver can then decide to either plead guilty to the SJPN, or not guilty. Pleading not guilty would then see the matter being referred to a magistrates court. Of course pleading not guilty would only be sensible if there was an actual defence, not sure what this would be based on the information provided.

Seems somewhat banged to rights to me. You can’t drive on the pavement – even if there is nowhere else to park -  and whoever drove that vehicle did. I would suggest that it does fall below the standard expected of a competent and careful driver (which is the definition of careless driving).

You don’t say who the notice was addressed to, but whoever it was must respond to the request for driver’s details. Failure to do so is a separate offence which carries six points.
