NIP - driving without due care and attention

As I was coming down a small hill I had both hands of the handlebars of my motorbike, an unmarked copper saw me from a way off on the other side of the road and pulled me over.

At the roadside he gave a verbal NIP and said that I would get an FPN through immediately via email. It didn't come through he then said it should arrive the next day.

I have since received a NIP via email(see below)but nothing else. It is now 2 months since the incident happened (I know they have 6 months to prosecute so not getting my hopes up)

If I do receive a summons to court is there I chance I would receive a worse penalty than 3 points and a fine.

I feel like they have me dead to rights so would rather have had the chance to accept the FPN rather than go to court.

The police now generally do not hand out penalties at the roadside. Instead, they submit a report to the back office where a decision is made on the appropriate action. The officer here may have been unwise to predict the outcome.

It is possible that the decision was that a COFP was not appropriate and court action was required.

Yes. Careless Driving carries up to nine points and an unlimited fine. In common with all offences which attract points, the court my disqualify you rather than impose points if the believe he offence is serious enough.

You might try contacting TVP to see if they have issued an offer of a fixed penalty and you have not received it. That may be worthwhile because if that has happened the offer will lapse and you will be dealt with in court anyway.

Thank you for the advice and I have now got in touch with TVP. However as it happened over two months ago I am worried that the offer will have already lapsed. If it has lapsed is there any chance I will be re offered it as I never received it?
