NIP: 49mps in 40mph zone A20 Eastbound

I have just received the NIP and would like your advice as to what to do.



I have reviewed the online evidence. There are no road markings (horizontal lines) and the photographs are barely legible on the website.

What's the best thing to do here?

So, you are looking for advice on challenging the allegation based on the photos online, and posted scans of the NIP instead for no apparent reason, other than possibly to avoid the effort of posting any potentially relevant details directly?

Not necessarily. Just looking for general advice in the first instance. Also, the photos are accessible via the information on the NIP, but you would know that.

Alongside your full name and home address, and the ability for anyone to log on and respond to the notice on your behalf.

It may be wise to hide the login details, and simply share the images in this thread instead.

Were you / the car there? Is it likely you were speeding?  Regardless, you must respond to the letter within the 28 days naming the driver.

Yes, I was there. I have updated the post with the pictures, same quality as the site.

I was previously advised to upload front and back of all correspondence. Has this changed? Haven't used the site in a while.

For council tickets, the regulations are very prescriptive, and those that deal with such cases expect to be able to access the online images. For speeding matters, not so much - and those giving up their free time to advise are less inclined to go dig for the relevant info.

This site has been around for about a year, so your version of “a while” and mine may differ. Either way, you have given scant information, making it very difficult to give any meaningful advice. Making things very difficult for people who are trying to help you for free is generally unwise.

From the photos it looks like an average speed camera setup, so lines on the road (or lack of) won't help you. The scan is of such a poor quality I can't read any of the text to confirm what the photos are showing.

You can't appeal a NIP, once you send back the request to name the driver, you will be offered a speed awareness course or a conditional offer of a Fixed Penalty. You either accept the course or CoFP, or you let the matter go to court. At court you would then have the chance to defend the charge but I'm not sure you have anything that would allow you to do that.

It is my guess (from the photos and the 40mph limit) that the location is somewhere between Crittals Corner (Jn with A224) and the McDonalds/BP service area. Perhaps round about here:

Around last December the limit on that stretch was reduced from NSL to 40mph. Poor drainage led to frequent bad flooding. The reduced limit, which is enforced by an average speed system, saw large numbers of contraventions and it was alleged the signage was insufficient or confusing. The stretch is to be closed this coming BH weekend for remedial work which may see the stretch restored to NSL.

Perhaps the OP could confirm whether or not I am correct.

It says location A20 Eastbound, west of Sandy Lane and east of Cookham Road.
