Hi,

I should be grateful to understand if I have any grounds to contest the alleged offence (see attached).

Thank you in advance,

Are you sure you want all of your personal information all over the internet?
I am not qualified to give legal advice in the UK. While I will do my best to help you, you should not rely on my advice as if it was given by a lawyer qualified in the UK.

OP, are you the Registered Keeper of the vehicle? I.e. do you have the V5C (Logbook) in your possession, and are the details correct?

I am not the registered keeper as it's a works van.

In that case, nothing you have told us suggests "any grounds to contest the alleged offence". But then again, you have told us next to nothing.

I'm not sure if there is much more to tell. I was the driver of the mentioned vehicle, I was following the flow of traffic, I did see the Police camera van, which was wedged in alongside a number of parked vehicles so hidden from oncoming traffic. The road in question is quite steep and I was approaching going downhill with the camera van catching vehicles as they descend.

It looks like I'm "bang to rights" on this but just thought i'd check with the experts here before submitting my details.

Thank you again

Even if you have a defence your reply to the NIP is not the place to say you want to defend it. The NIP asks you only to identify who was driving. Nothing else.

Failing to return the NIP and provide the information within the deadline is a serious offence - more serious than the speeding charge. As it says on the NIP, not identifying the driver can result in £1,000 fine + 6 points on your licence.  With luck 38mph in a 30 mph limit should get you an offer of doing a Speed Awareness Course, so no conviction, no fine and no points. As long as you haven't already done the course within the last 3 years.
