NIP 24mph in 20

I received an NIP yesterday, the first one in my 20-odd years of driving! It seems harsh but there has to be a cutoff point somewhere. So, I'm not denying it was me. Going on the website I have 3 options: Make an Admission, Make a Nomination or Challenge the Accusation. Do I just make an admission? I'm hoping I might be offered a road safety awareness course, but I guess if it ends up as points and a fine I'll just have to suck it up. As I said, having not done this before I'm not sure what to expect.


I feel like I want to explain what happened by emailing them, but I'm assuming I'd just be wasting my time if I did? I'll say it here just to get it off my chest, so apologies, you don't have to read further... It's a horrible road that I tend to avoid, I wish I had that day too. It was raining and as usual, on my side of the road, there was a continual line of parked cars going all along the bend, so I was two thirds of the way into the opposite lane to give reasonable clearance. My priority was looking for hazards and I knew I wasn't going fast. As soon as I got around the bend I did a quick look around, saw the road ahead was clear, then saw the dark (possibly charcoal grey?) Police Enforcement Vehicle van behind more parked cars and had already lifted my foot off the accelerator, so by the time I glanced down at my speedo I was a whisker above 20mph. I knew it was too late, but berated myself all the way home. I knew I wasn't speeding excessively, but couldn't have said exactly what speed. It's also a road that used to be 30mph, but changed in the last year or so to 20. When I was growing up in the area it was actually 40mph around that section.

The sooner you nominate yourself as the driver, assuming this to be the case, the more likely you are to be offered a course in lieu of penalty points.
Enforcement starts at +10%+2mph so your are within these guidelines. Don’t bother “explaining” it, they’ve heard it all before, don’t care, and it’s just a sausage machine.
Take the course and put it down to experience. If you haven’t been on a course recently it will be offered, so the sooner the better. If you delay they will prosecute instead.

Don’t bother with the waffle because they might treat it as an equivocal nomination and hit you with 6 points for failing to nominate the driver. Not worth the risk just to make you feel better.

Definitely challenge the allegation on the basis that you had no chance of seeing the camera van because the conditions were such that it would have been dangerous to drive at that speed without focussing 100% on whatever was just in front of you.

Thanks @jfollows, you have confirmed my thoughts. The letter is dated the 10th and it arrived yesterday, so I'm well within the time limit. In my whole driving history I've only had one parking ticket, so I'm really hoping a course will be an option!

Thanks @andy_foster. I suppose I'm not sure if it's worth the risk to challenge it, I don't want to make my outcome worse. I have no evidence to show where/how the van was parked, so I only have my memory to go by. The photos show me mainly on the other side of the road but don't show any of the parked cars I was passing. I think this may just be one of those things to chalk up to experience.

Thanks @DWMB2. My head isn't in the right place to read between the lines at the moment, so I appreciate your input. I'm sure to a lot of people it would be trivial and I guess in the grand scheme of things it is, I was just hoping to get some insight on if ticking the 'it's me' box is all I need to do and what happens next. Sorry if I've wasted anyone's time.

The options you say you have been given may lead to confusion. It suggests you have the choice of challenging the accusation or making an admission/nomination.

You don't. You must respond to the request for driver's details (by either admitting you were driving or nominating somebody else). This is regardless of whether you (or somebody who you nominate) wish to challenge the accusation. Only the person who was driving can make that challenge.

You will almost certainly be offered a course for that speed (provided the offence did not occur in Scotland).

Thanks @NewJudge. You're right, I think it was that option that was confusing me, but I suppose it's there more for when the first two options don't apply. Don't worry, I will be admitting I was driving. I'm not in Scotland, but that is interesting to know!
