Hi,

I was recently a trip from Kent to Oxfordshire, I was with my wife which means I was more acutely aware of my driving and speeds than I might be ordinarily.

So a few weeks later I was very surprised to receive an NIP.

I was using mostly ACC (Adaptive cruise control,) as large parts of the journey had variable speeds limits and this is my way to reduce tiredness and reduce the possibility of speeding!

The only rationale I have is;
I believe that I had already passed this sign before it became illuminated and I was decelerating, or I started slowing down as I reached the sign, I really cannot make sense of this.
You may note on. the opposite side of the road, a police car, so there is no way this was intentional, nor would it be otherwise.

Any help and/or feedback would be appreciated, I have already received a similar NIP some 6/7 years prior and was required to take a speed awareness course ( and x3 points), so do not believe I will be offered the same, I cannot afford to get points as I drive for work.

Are you suggesting that the "50" limit was not displayed when you passed the gantry? I would be surprised because the cameras are not activated to trigger at the lower limit until some time after it has changed. Or are you saying it was, but you only started to slow down after you had passed it?

I would be surprised if you were required to take a course and had three points imposed - it's one or the other, not both. Howeverit's of no consequence that will have no bearing on this matter - it was too long ago. You should be offered a course for that speed. You are bang on the upper limit for such an offer - (Limit + 10% +9mph) so 64mph.

Hi @ NewJudge thanks for your response.

I really cannot fully recall, I know that I was being extra vigilant as it was a long drive and that this was around 60 minutes in to it. I "think" I may have began to slow down after I passed the gantry, but again this would not be typical behaviour for me, as I tend to slow down as soon as I see the new speed limit, but this seems to be the only logical conclusion.

Photos say limit changed 45 mins before the photo. A long while since the event, are you the registered keeper?

Yes, I recently noticed this on the photo, my wife is the registered keeper.

So who has received the NIP - you or her?

Whichever, all you can do at this stage is to reply naming the driver.

One question.
You state that:

How long exactly from the date of the offence was it before you received the NIP? and was this the first correspondence received or did your wife get an earlier notice that she responded to naming you as the driver?

Hi,
NIP received around 10-14 days later, my wife neglected to give to me, then replied offering myself as the named driver.This was the only correspondence, until I received a letter, under my name, some 14 days or so later

She had no reason to give it to you. In fact quite the opposite - she was obliged to respond to it herself.

No, I know it wasn't a criticism. Initially you said you were surprised to have received a NIP and then suggested that part of that surprise may have stemmed from your wife not passing her NIP to you.

I can only assume that, not only did your wife not pass her NIP to you (which she had no need to do) but also that she didn't mention she had received it and had subsequently named you as the driver (which I find odd, especially as she was with you when the alleged offence occurred). Hence I find it odd that you were surprised to have received your own NIP.

One of NJ's failings is that he tries too hard to help people who are determined to only tell us half the story. Hopefully he will get the help he so desperately needs.

You told us that you were surprised to receive a NIP. This is "half a story". I have long since ceased caring whether or not there is a potential defence hidden behind the other half of the story, or whether it is just random noise.

That said, beyond his irrational desire to help those that exhibit little apparent desire to help themselves, I see no error in his logic.
