If you have received an SJPN you won't avoid all the court stuff. That has already begun and the SJPN is your notification of that.

Are you sure that the SJPN mentions only "Failing to provide driver's details"?

I am surprised that the police sent you a "Notice of Intended Prosecution" (NIP) saying they plan to prosecute you under Section 172(3). I'm even more surprised that they say they are doing so in accordance with the requirements of Section 1 of the Road Traffic Offenders' Act as no NIP is required for Section 172 offences.


Yes this is the only letter I received, what would ur advice be onto what to do next, I have a lawyer call coming up to guide me as well

So you have not received a "Single Justice Procedure Notice" (SJPN) yet then?

If not, you could try contacting the police to see if they will send you another "request for driver's details". You've left us to guess when the offence is alleged to have occurred (and  o guess what that offence is - I assumed it was speeding)but I'm guessing it was more than three months ago, so I doubt that they will.

If they won't, I suggest you wait until you receive your SJPN to see what you are charged with.

Hi

I am awaiting a reply from the officer who issued it,

Am sorry if it doesnt make sense but I will clear it up a bit more.

I got a letter 2 weeks ago ( the one in chat previously ) saying I am being prosecuted for failing to provide driver details from the previous letter they sent me in march.

The officers reply to my email when I questioned the offence was “poor driving standards” so something  minor am guessing.

You said to wait to see what am charged with but isnt that letter that I posted in the group showing am charged with failing to provide only? Guessing they had no evidence for the poor driving standards

The letter they sent you in March would have contained the intended charge you would face for the driving offence. The usual procedure when matters go to court in circumstances like yours is to lay charges for the original driving offence (which sounds like careless driving) and the FtP offence. You want to avoid a conviction for FtP if at all possible as it has nasty consequences (more nasty than low-level careless driving).

As I said earlier, I don't know why the police sent you the letter you posted on here as there is no requirement to warn you that prosecution for the FtP offence is being considered. 

There is a way to approach this if you face both charges, but until you know that you do (which will be revealed when you receive your SJPN) there is no point in going down that road yet.

If they had no evidence they would not have sent you the original letter warning you that you might be prosecuted and asking you to provide the driver's details. They have to suspect that you are guilty of an offence. They don't just send out the requests hoping you don't reply so that they can prosecute you for failing to do so.

So, after drip feeding us, you have told us that you have variously received one letter and one SJPN letter and have posted the only letter that you have received - which is clearly not an SJPN.

As you are clearly either incapable of or unwilling to provide a straight answer to simple and relevant questions, I'm closing this thread.
